NOTICE OF A PROPOSED KILBY DITCH/ LOW LYING AREA CORRECTIVE MEASURE IMPLEMENTATION PLAN AND INSTITUTIONAL CONTROL PROGRAM PLAN SUBMITTED UNDER THE SETTLEMENT AGREEMENT FOR VOLUNTARY RESPONSE FOR THE COLISEUM BOULEVARD PLUME (CBP) SITE LOCATED IN MONTGOMERY, ALABAMA.
The Alabama Department of Transportation (ALDOT) has completed Site Investigation activities under the Settlement Agreement for Voluntary Response at the Coliseum Boulevard Plume site located in Montgomery, Alabama. The CBP includes four major areas: Kilby Ditch, Probehole 12, Low Lying Area, and the Southwestern Area. The Kilby Ditch/Low Lying Area Corrective Measure Implementation Plan and Institutional Control Program Plan have been determined to be complete by the Alabama Department of Environmental Management (ADEM). The Kilby Ditch/Low Lying Area Corrective Measure Implementation Plan and Institutional Control Program Plan outlines work which will be conducted at the Kilby Ditch and Low Lying Area locations to restrict access to and treat surface water. The Institutional Control Program Plan describes Institutional Control measures to be used to restrict access to and use of groundwater at the CBP. These plans constitute portions of the planned remedial actions to be performed at the CBP. Other portions of the overall CBP remedial action plan will be made available for public review and comment once they are determined to be complete, but prior to approval by the Department.
Copies of the fact sheet, Kilby Ditch/Low lying Area Corrective Measure Implementation Plan and the Institutional Control Program Plan are available for public inspection through May 15, 2009, during normal business hours Monday through Friday, except legal holidays at the following locations:

Copies may be obtained by contacting Mr. Russell Kelly, ADEM, at the above address. A nominal fee for copying and/or mailing will be charged. Arrangements for copying should be made in advance.
In order to affect final decisions, all comments must address issues that have an impact on the applicant’s ability to comply with applicable environmental laws, rules, and regulations. Any interested persons wishing to comment on the Plans should submit such comments in writing to ADEM, ATTENTION: Mr. Russell Kelly at the Montgomery address. Comments should be received by 5:00 p.m on May 15, 2009. ADEM maintains a list of interested individuals who are mailed legal notices issued by the Department. All comments received during the public comment period will be considered in the formulation of a final determination regarding approval of the Plans. After consideration of all formal comments, the Department will make its final decision regarding approval of the Plans. When the Department makes a final decision, notice will be given to the applicant and each person who has submitted written comments or requested notice of the final decision. If the Plans are substantially changed, the Department will issue a public notice indicating the revised conditions prior to its final decision.
This notice is hereby given on the 15th day of April, 2009, by authorization of the Alabama Department of Environmental Management.
