PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Hoerbiger Drivetech USA, Inc. which operates an automotive parts manufacturing facility in Auburn, Lee County, Alabama.
The violations for the above named facility consist of failure to: maintain the required hazardous waste training documents and records at the facility, develop a contingency plan, maintain documentation of the weekly inspections of the hazardous waste storage area (HWSA), construct a containment system for the HWSA, maintain adequate aisle space in the HWSA, post required signage at each entrance to the HWSA, provide a method to prevent the unknowing and/or unauthorized entry to the active portion of the facility, and transport off-site for disposal, treatment or storage hazardous waste within the 90-day time period.
The Department is proposing a civil penalty in the amount of $24,000.00. The Order, if issued, would require Hoerbiger Drivetech USA, Inc. to comply with all applicable requirements of ADEM Administrative Code div. 335-14 immediately upon the effective date of the Order and continuing each and every day thereafter.
