NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

AUTAUGA COUNTY

Alabama Power Company, 600 18th Street North, Birmingham, AL 35203, NPDES Permit Number AL0073695, located at 3305 County Road 26, Billingsley, AL 36006, for reissuance of a permit, which authorizes discharges resulting from cooling tower blowdown and low volume wastes, and low volume waste as defined by 40 CFR 423  from DSN001A through DSN001 to Little Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin; and storm water from impoundment areas and miscellaneous wastewaters as described in application through DSN002 to an unnamed tributary to Little Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin. At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

Tenaska Alabama Partners, LP, 14302 FNB Parkway, Omaha, NE 68154, NPDES Permit Number AL0072788, located at 3405 County Road 26, Billingsley, AL 36006, for reissuance of a permit, which authorizes discharges resulting from cooling tower blowdown through DSN001 to Little Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin; and low volume waste sources defined by 40 CFR 423 through DSN002 to Little Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin; and storm water associated with production of steam and electricity through DSN003 and DSN004 to an unnamed tributary to Little Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin. At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

BALDWIN COUNTY

Bon Secour Fisheries, Inc., PO Box 60, Bon Secour, AL 36511, NPDES Permit Number AL0003298, located at 17449 County Road 49 South, Bon Secour, AL 36511, for reissuance of a permit, which authorizes discharges resulting from screened floor wash down and process wastewater from shucking and washing oysters, and preparing fish, through DSN001; Low volume screened floor drains, through DSN005 and DSN006; Stormwater runoff associated with seafood processing activities, through DSN008, DSN009, and DSN011; Wastewater from oyster washing and stormwater runoff associated with seafood processing activities through DSN010; Uncontaminated storm water from bulk petroleum secondary containment areas, through DSN012. All Outfalls discharge to Bon Secour River, classified as Swimming and Fish & Wildlife, in the Mobile Basin.

MOBILE COUNTY

Alabama State Port Authority, PO Box 1588, Mobile, AL 36633, NPDES Permit Number AL0002976, located at US Hwy 98 Blakeley Island, for reissuance of a permit, which authorizes discharges resulting from treated storm water and groundwater from the aluminum ore tailing leachate collection system, through DSN001 to the Mobile River, classified as Limited Warmwater Fishery, in the Mobile River Basin.

Deep Sea Foods, Inc., 14530 Shell Belt Road, Bayou La Batre, AL 36509, NPDES Permit Number AL0027979, located at the same address, for reissuance of a permit, which authorizes discharges resulting from screened wastewater resulting from the processing of shrimp, through DSN001 to Portersville Bay, classified as Shellfish Harvesting/Swimming/Fish & Wildlife, in the Escatawpa River Basin; and cooling tower blowdown, through DSN002 to Bayou La Batre, classified as Fish & Wildlife, in the Escatawpa River Basin.

Zenith Energy Terminals Holdings, LLC, 835 Cochrane Causeway, Mobile, AL 36610, NPDES Permit Number AL0083127, located at 500 Viaduct Road, Chickasaw, AL 36611, for reissuance of a permit, which authorizes discharges resulting from hydrostatic test water and storm water runoff associated with the handling and storage of crude oil, petroleum products and bulk chemicals including acids, bases, and organic chemicals, through DSN001 and DSN002 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin; and hydrostatic test water, boiler blowdown, and storm water runoff associated with the handling and storage of crude oil, petroleum products and bulk chemicals including acids, bases and organic chemicals, through DSN003 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin.

Zirlotts Gulf Products, 14735 Commodore Avenue, Coden, AL 36523, NPDES Permit Number AL0070220, located at the same address, for reissuance of a permit, which authorizes discharges resulting from screened process wastewater from processing non-breaded shrimp, hand-shucked oysters and blue crabs, through DSN001 to the West Fowl River, classified as Swimming/Fish & Wildlife, in the Escatawpa River Basin.

Plant #1, 2120 Warrenton Road, Guntersville, Alabama 35976, NPDES Permit Number AL0000060, located at 2120 Warrenton Road, Guntersville, Marshall County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry and wet preparation limestone quarry and associated areas, discharging to unnamed tributaries to Browns Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

TALLADEGA COUNTY

Vulcan Construction Materials, LLC. Speedway Quarry, 1200 Urban Center Drive, Birmingham, Alabama 35242, NPDES Permit Number AL0066320, located at 7575 Eastaboga Road, Eastaboga, Talladega County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation limestone quarry and associated areas, discharging to an unnamed tributary to Choccolocco Creek and an unnamed tributary to Eastaboga Creek, classified as Fish and Wildlife, in the Coosa River Basin.

TUSCALOOSA COUNTY

PGP Operating, LLC - Brush Creek, 17300 Brookwood Parkway, Vance, Alabama 35490, NPDES Permit Number AL0060798, located on Camp Cherry Austin Road Tuscaloosa, Tuscaloosa County, Alabama, for issuance of a permit that limits discharges of produced water from a coalbed methane operation and associated areas, discharging to the Black Warrior River, classified as Swimming and Other Whole Body Water-Contact Sports and Fish and Wildlife, in the Black Warrior River Basin.

The subject permit regulates the discharge of treated wastewater to Mohorn Creek, which is classified as Fish and Wildlife, in the Cahaba River Basin.

CLEBURNE COUNTY

Living Water Utilities, LLC, 5800 Feldspar Way, Suite 200, Birmingham, Alabama 35244, NPDES Permit Number AL0083097, for reissuance of a permit which limits the discharge of pollutants from treated domestic from Hardy WC WWTP, 213155 Interstate 20, Heflin, AL 36264, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Kemp Creek, a waterway classified as Fish & Wildlife, in the Tallapoosa River Basin.

ETOWAH COUNTY

The Water Works and Sewer Board of the City of Gadsden, Alabama, PO Box 800, Gadsden, AL, 35902, NPDES Permit Number AL0022659, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from the Gadsden East River WWTP, 601 Paden Rd., Gadsden, AL, 35902, for the purpose of meeting federal and state water quality regulatory standards. MACON COUNTY

Utilities Board of the City of Tuskegee, PO Box 831050, Tuskegee, Alabama 36083, NPDES Permit Number AL0048763, for the modification of a permit which limits the discharge of pollutants from treated domestic and storm water runoff from the Tuskegee North WPCP, 2485 Macon County Road 8, Franklin, AL 36083, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water runoff to the Tallapoosa River, a waterway classified as Fish & Wildlife, in the Tallapoosa River Basin.

MOBILE COUNTY

South Alabama Utilities, PO Box 428, Citronelle, Alabama 36522, NPDES Permit Number AL0081299, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Miller Creek WWTP, located at Johnson Road, Mobile, Alabama 36695 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Miller Creek, classified as Fish & Wildlife, in the Escatawpa River Basin.

City of Columbiana, 107 Mildred Street, Columbiana,  AL 35051, NPDES Permit Number AL0024589, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Columbiana WWTP, 459 Highway 70 West, Columbiana, AL 35051 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Waxahatchee Creek, classified as Fish & Wildlife, in the Coosa River Basin.

ST CLAIR COUNTY

Ragland Housing Authority, PO Box 69, Ragland,  AL 35131, NPDES Permit Number AL0043338, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ragland Housing Authority, 406 8th Street, Ragland, AL 35131 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Trout Creek, classified as Fish & Wildlife, in the Coosa River Basin.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
