PROPOSED ADMINISTRATIVE ORDER
Colbert County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Bruce Ussery for failure to close an Unauthorized Dump site located at 7455 Hawk Pride Mountain Road in Tuscumbia, Colbert County, Alabama.
The violations consisted of Bruce Ussery creating and not properly closing an Unauthorized Dump site.
The Department is proposing a civil penalty in the amount of $6,000. The Order, if issued, would require Bruce Ussery to cease and desist the operation of the scrap tire site, and to submit an abatement plan to the Department. This plan would require the removal and proper disposal of all regulated wastes, and a schedule for abatement completion.
Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:

The comment period shall end at the close of business 30 days from the publication date of this notice. This notice is hereby given this 24th day of September, 2021, by authorization of the Alabama Department of Environmental Management.
