PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Code of Alabama §§ 22-22A-1 through §§ 22-22A-17 (2006 Rplc. Vol.), and the Solid Wastes and Recyclable Materials Management Act (SWRMMA), Ala. Code §§ 22-27-1 to 22-27-18 (2006 Rplc. Vol.) as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to the City of Selma, which operates the City of Selma C/D Landfill, a construction and demolition facility in Selma, Dallas County, Alabama.

The violations listed in the Order consist of: failure to manage surface water, inadequate application of cover material, failure to maintain on-site drainage structures, failure to maintain adequate equipment, failure to ensure only approved waste streams are accepted at the facility and failure to properly maintain landfill slopes.

The Department is proposing a civil penalty in the amount of $15,775.00.  The Order, if issued, would require the City of Selma C/D Landfill to correct all violations above within the prescribed timeframes, and to operate in compliance with ADEM Admin. Code 335-13 and Solid Waste Disposal Permit No. 24-07 in the future.
