NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

BALDWIN COUNTY

Billys Seafood Inc., PO Box 309, Bon Secour, AL 36511, NPDES Permit Number AL0068497, located at 16780 River Rd, Bon Secour, AL 36511, for reissuance of a permit, which authorizes discharges resulting from screened washdown water from seafood packing and freezing operations, through DSN001 to Bon Secour River, classified as Swimming and Fish & Wildlife, in the Mobile River Basin; and for discharge of water from loading and unloading of seafood, through DSN002 to Bon Secour River, classified as Swimming and Fish & Wildlife, in the Mobile River Basin.

DALLAS COUNTY

Globe Metallurgical Inc., 2401 Old Montgomery Highway, Selma, AL 36703, NPDES Permit Number AL0025216, located at the same address, for reissuance of a permit, which authorizes discharges resulting from non-contact cooling water and storm water associated with silicon metal production activities, through DSN001 to Tarver Creek, classified as Fish and Wildlife, in the Alabama River Basin; and discharges resulting from storm water runoff associated with silicon metal production activities, through DSN002 to Alabama River, classified as Fish and Wildlife, in the Alabama River Basin.

JEFFERSON COUNTY

SMI Steel LLC - CMC Steel Alabama, 101 South 50th Street, Birmingham, AL 35212, NPDES Permit Number AL0001554, located at the same address, for reissuance of a permit, which authorizes discharges resulting from process and cooling waters from steel manufacturing processes through DSN001 and groundwater and municipal water used for flow augmentation to an unnamed tributary to Village Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.  The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the entity providing water is a public water system.

SHELBY COUNTY

Southern Company Services Inc. - Power Systems Development Facility, PO Box 1069, Wilsonville, AL 35186, NPDES Permit Number AL0069272, located at 31800 Highway 25 North, Wilsonville, AL 35186, for termination of a permit, which authorizes discharges resulting from non-contact cooling water blowdown through DSN001, stormwater runoff, boiler blowdown, washdown water, flush-out and firewater through DSN002, stormwater runoff through DSN003 and DSN004, and treated sanitary wastewater through DSN005, to an unnamed tributary to Yellow Leaf Creek, classified as Fish and Wildlife, in the Coosa River Basin.

John H. Payne – Culpepper Chert Pit, 2952 County Road 104, Cedar Bluff, Alabama 35959, NPDES Permit Number AL0072591, located at 1485 County Road 82, Cedar Bluff, Cherokee County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dirt and/or chert mine and associated areas, discharging to Groundwater and an unnamed tributary to Spring Creek, in the Coosa River Basin.

ST CLAIR COUNTY

St. Clair County Commission – St. Clair County Road Department Shop Chert Pit, 165 5th Ave., Suite 100, Ashville, Alabama 35953, NPDES Permit Number AL0083623, located at 31588 Hwy 231, Ashville, St. Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dirt and/or chert mine and associated areas, discharging to Groundwater and an unnamed tributary to North Fork Dry Creek, in the Coosa River Basin.

Town of Thorsby, PO Box 608, Thorsby, AL 35171, NPDES Permit Number AL0050636, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Thorsby HCR Lagoon, East Jones Street, Thorsby, AL 35171, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Yellow Leaf Creek, classified as Fish and Wildlife, in the Coosa River Basin.

JEFFERSON COUNTY

Jefferson County Commission, 716 Richard Arrington Jr. Blvd. N, Suite A300, Birmingham, AL 35203, NPDES Permit Number AL0026913, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and storm water runoff from Five Mile Creek WRF, 3410 Happy Hollow Lane, Fultondale, AL 35068, for the purpose of meting Federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and storm water runoff to Fivemile Creek, classified as Fish & Wildlife, in the Black Warrior River Basin.

MARSHALL COUNTY

River Bend Marina, LLC, 133 Riverbend Circle, Suite 1, Guntersville, AL 35976, NPDES Permit Number AL0042366, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from River Bend Marina, LLC WWTP, 133 Riverbend Circle, Guntersville, AL, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Tennessee River (Guntersville Lake), classified as Swimming and Fish and Wildlife, in the Tennessee River Basin.

MORGAN COUNTY

Town of Falkville, P O Box 407, Falkville, Alabama 35622, NPDES Permit Number AL0021113, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Falkville HCR Lagoon, Robinson Creek Road, Falkville, Alabama 35622, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Flint Creek, classified as Fish & Wildlife, in the Tennessee River Basin.

RANDOLPH COUNTY

Water, Sewer, & Gas Board of the Town of Wedowee, PO Box 935, Wedowee, AL 36278, NPDES Permit Number AL0024171, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Wedowee Lagoon, Woodland Lane, Off Alabama Highway 48, Wedowee, AL 36278, for the purpose of meting Federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Wedowee Creek, a waterway classified as Fish & Wildlife, in the Tallapoosa River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
