NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

United States Army Aviation Center for Excellence (USAACE) and Fort Rucker, USAACE, AMIM-RCP-E, Building 1121, Fort Rucker, AL, 36362, NPDES Permit Number AL0002178, located at the same address, for reissuance of existing discharges resulting from storm water associated with military base operations, through DSN001, DSN002, DSN004-DSN006 into an Unnamed Tributary to Brooking Mill Creek, classified as Fish & Wildlife, in the Choctawhatchee River Basin; storm water associated with military base operations, through DSN003 into Unnamed Tributary to Harrand Creek, classified as Fish & Wildlife, in the Choctawhatchee River Basin; storm water associated with military base operations, through DSN007 into Unnamed Tributary to Choctawhatchee River, classified Fish & Wildlife, in the Choctawhatchee River Basin.

Stewart Blvd, Sylacauga, AL, 35150, for reissuance of existing discharges resulting from storm water runoff from fertilizer blending operations, through DSN001 into an Unnamed Tributary to Tar Water Branch, classified as Fish & Wildlife, in the Coosa River Basin.

TUSCALOOSA COUNTY

Cox Wood of Alabama, PO Box 286, Vance, AL, 35490, NPDES Permit Number AL0079332, located at 10810 Burt Drive, Woodstock, AL 35188, for modification of a permit, which authorizes discharges resulting from stormwater associated with pole mill and wood preserving operations through DSN001, and discharges resulting from boiler blowdown and stormwater associated with pole mill and wood preserving operations through DSN002 to an unnamed tributary to Banks Creek, classified as Fish & Wildlife, in the Cahaba River Basin.

Carbo Ceramics, Inc. – Carbo-Belcher Bauxite Pit, 36 Arch Drive, Eufaula, Alabama 36027, NPDES Permit Number AL0082830, located at 1544 County Road 79 S, Eufaula, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic clay mine and associated areas, discharging to an unnamed tributary to White Oak Creek, Classified as Fish and Wildlife, in the Choctawhatchee River Basin.

HENRY COUNTY

Carbo Ceramics, Inc. – Carbo-Sellers Bauxite Pit, 36 Arch Drive, Eufaula, Alabama 36027, NPDES Permit Number AL0082724, located on AL Hwy 95 and County Road 204, Abbeville, Henry County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic clay mine and associated areas, discharging to an unnamed tributary to Abbie Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

The Water Works and Sewer Board of the City of Greenville, PO Box 483, Greenville, AL 36037, NPDES Permit Number AL0020532, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from the Greenville WWTP, 326 Elm Lane, Greenville, Alabama, 36037, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to an unnamed tributary to Persimmon Creek, which is classified as Fish and Wildlife, in the Escambia River Basin.

CULLMAN COUNTY

Living Water Utilities, LLC, 5800 Feldspar Way, Suite 200, Birmingham, AL  35244, NPDES Permit Number AL0084107, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Living Water Reclamation Facility, Highway 278, Cullman, AL  35055 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Copperas Branch, classified as Fish & Wildlife, in the Black Warrior River Basin.

DALE COUNTY

The Water Works and Sewer Board of the City of Daleville, PO Box 188, Daleville, AL 36322, NPDES Permit Number AL0050261, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Daleville Southeast Lagoon, 192 Clark Street, Daleville, AL 36322, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Choctawhatchee River, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

The Water Works and Sewer Board of the Town of Ariton, Alabama, PO Box 53, Ariton, AL 36311, NPDES Permit Number AL0068551, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Ariton Lagoon, Alabama Highway 123 N, Ariton, AL 36311, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Pea River, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

JEFFERSON COUNTY

Phoenix Water Resources, LLC, PO Box 875, Selma, AL 36702, NPDES Permit Number AL0056685, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Eastwood Mobile Home Village WWTP, 1961 Alton Road, Irondale, AL 35210 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Abes Creek, classified as Fish & Wildlife, in the Cahaba River Basin.

WALKER COUNTY

Carbon Hill Utilities Board, PO Box 459, Carbon Hill, AL 35549, NPDES Permit Number AL0024341, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Carbon Hill WWTP, 980 Brookside Rd NE, Carbon Hill, AL 35549, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Lost Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
