PROPOSED ORDER
Tuscaloosa County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Industrial Coatings & Services, LLC (EPA Identification Number ALR000067629), which owns/operates an industrial coating and degreasing facility located at 4711 Fosters Industrial Lane in Tuscaloosa, Tuscaloosa County, Alabama.
The violations consisted of the following: offering hazardous waste for transport to a transporter that was not permitted to transport hazardous waste in Alabama, failure to prepare a uniform hazardous waste manifest for each shipment of hazardous waste, failure to properly mark or label containers of hazardous waste, failure to make a hazardous waste determination on waste generated at the facility, failure to notify the Department and obtain an EPA ID number, failure to document the quantity of hazardous waste generated each calendar month, failure to prevent unknowing entry into the hazardous waste storage areas, failure to post required signage at each entrance to the central accumulation area, failure to conduct or document weekly inspections of all hazardous waste accumulation areas, failure to ensure that all personnel complete required training before handling hazardous waste, failure to have a contingency plan for the facility, and failure to send the facility’s contingency plan to all local emergency responders.
The Department is proposing a civil penalty in the amount of $15,060. The Order, if issued, would require Industrial Coatings & Services, LLC to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Stephen A. Cobb, Chief of the Land Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice.
