NOTICE OF PROPOSED RENEWAL & TRANSFER OF A CONSTRUCTION/DEMOLITION WASTE LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Houston County

Omussee C and D LLC applied to the Alabama Department of Environmental Management (ADEM) for renewal of the Solid Waste Disposal Facility Permit for the Omussee C/D Landfill (Permit 35-08). In addition, a request was submitted to transfer Solid Waste Disposal Facility Permit (35-08) from Hughes Farms, LLC to Omussee C and D LLC. The facility’s name would also change from Hughes C/D Landfill to Omussee C/D Landfill.   The waste stream for the Hughes C/D Landfill would remain non-putrescible and non-hazardous construction and demolition waste, tires, and rubbish as defined by ADEM Rule 335-13-1-.03.  The service area for the Hughes C/D Landfill would remain the City of Dothan, Alabama, Counties in Alabama: Houston, Coffee, Geneva, and Henry, Counties in Florida: Escambia, Santa Rosa, Okaloosa, Walton, Holmes, Washington, Bay, Jackson, Calhoun, and Gulf, and Counties in Georgia:  Muscogee, Chattahoochee, Stewart, Quitman, Clay, Early, Miller, Seminole, Decatur, Grady, Mitchell, Baker, Calhoun, Randolph, Terrell, Webster, Marion, Sumter, Lee, Dougherty, Worth, Colquitt, Thomas, Tift, and Cook. The maximum average daily volume of waste disposed at the Hughes C/D Landfill would remain 500 tons a day. All previous variances have been requested and shall be approved by the department.

The landfill is located in Section 33, Township 4 North, Range 27 East in Houston County, Alabama. The permitted facility consists of approximately 140.97 acres with 38.96 acres approved for disposal.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
