NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

COLBERT COUNTY

Messer LLC, 1040 Industrial Drive, Cherokee, Alabama 35616, NPDES Permit Number AL0040100, located at the same address, for reissuance of a permit which authorizes discharges resulting from non-contact cooling water, non-contact condensate, and stormwater runoff associated with inorganic chemical manufacturing discharging through Outfalls DSN001 and DSN01A into an unnamed tributary of the Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin.  The facility obtains cooling water from a cooling water intake structure operated by another entity.  Based on 40 CFR 125.91(b), the Permittee is subject to the federal requirements for cooling water intake structures at existing facilities and must document that the cooling water intake structure at the independent supplier’s facility meets the requirements of this rule under 40 CFR §125.94.

DE KALB COUNTY

JCG Foods of Alabama LLC, 764 George Cagle Drive, Collinsville, AL 35961, NPDES Permit Number AL0002241, located at the same address, for reissuance of a permit, which authorizes discharges resulting from process wastewater, sanitary wastewater and noncontact cooling water through DSN001 to Big Wills Creek classified as Fish and Wildlife, in the Coosa River Basin, and storm-water associated with poultry processing operations through DSN002, DSN003, and DSN004 to Big Wills Creek classified as Fish and Wildlife, in the Coosa River Basin.

The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the entity providing water is a public water system.

MADISON COUNTY

BASF Corporation Huntsville, 9800 Kellner Road, Huntsville, AL 35824, NPDES Permit Number AL0022039, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with industrial activities and fire system and deluge water during routine testing or emergency situation through DSN002 to Unnamed Tributary to Betts Spring Branch classified as Fish & Wildlife, in the Tennessee River Basin.

MORGAN COUNTY

Haier US Appliance Solutions, Inc., 2328 Point Mallard Drive, SE, Decatur, AL 35601, NPDES Permit Number AL0000272, located at the same address, for modification of a permit, which authorizes new or expanded discharges resulting from fire protection system test waters discharging through Outfall DSN001 and Outfall DSN003 to an unnamed tributary of the Tennessee River, classified as Fish and Wildlife, in the Tennessee River Basin; fire protection system test waters discharging through Outfall DSN004, Outfall DSN005, and Outfall DSN006 to the Tennessee River, classified as Public Water Supply, Swimming, and Fish and Wildlife, in the Tennessee River Basin; stormwater runoff associated with the manufacture of appliances discharging through Outfalls DSN009 and DSN010 to an unnamed tributary of the Tennessee River, classified as Fish and Wildlife, in the Tennessee River Basin.  The Department has determined that the discharge as proposed by the permit applicant is necessary for important economic and social development in the area in which the receiving water is located.

Mineral Extraction Facilities

BLOUNT COUNTY

The Alabama Department of Environmental Management has made a tentative decision to deny the request for MCoal Corporation – Rosa Mine, P.O. Box 3434, Wise, Virginia 24293, NPDES Permit Number AL0080080, located on US Highway 231, Rosa, Blount County, Alabama, for reissuance of a permit that limits discharges from a wet and dry preparation coal mining operation and associated areas, discharging to Andy Branch, an unnamed tributary to Andy Branch, Dry Creek, an unnamed tributary to Dry Creek, an unnamed tributary to Locust Fork, Hood Creek, Cold Branch, Singleton  Hollow, and an unnamed tributary to Singleton Hollow, all classified as Fish and Wildlife, in the Black Warrior River Basin. This denial is based on the facility’s submittal of an incomplete application associated with the requirements of ADEM Admin. Code ch. 335-6-6.

HENRY COUNTY

Imerys Refractory Mineral USA, Inc. – Wayne Green Pits 1, 2, & 6, 377 Highway 131, Eufaula, AL 36072, NPDES Permit Number AL0084042, located at 8222 County Road 57, Abbeville, Henry County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine and associated areas, discharging to Liberty Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

The City of Lanett, 401 North Lanier Avenue, Lanett, Alabama, 36863, NPDES Permit Number AL0023159, for reissuance of a permit which limits the discharge of pollutants from domestic and industrial wastewater, and storm water runoff from the Lanett WWTP, 1 Pecan Grove, Lanett, AL 36863, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water runoff to the Chattahoochee River, a waterway classified as Fish & Wildlife, in the Chattahoochee River Basin.

COLBERT COUNTY

Town of Cherokee, Post Office Drawer D, Cherokee, Alabama 35616, NPDES Permit Number AL0022594, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cherokee Lagoon, Township 3 S, Range 13 W, Section 7, Cherokee, Alabama 35616, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Tennessee River (Pickwick Lake), classified as Swimming, Public Water Supply, and Fish & Wildlife, in the Tennessee River Basin.

LAWRENCE COUNTY

Lawrence County Board of Education, 14131 Market Street , Moulton, Alabama 35650, NPDES Permit Number AL0043036, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Hatton High School WWTP, 6909 Alabama Highway 101, Town Creek, Alabama 35672, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Rutherford Creek, classified as Fish & Wildlife, in the Tennessee River Basin.

Huntsville Utilities Water Department, Post Office Box 2048 , Huntsville, Alabama 35804, NPDES Permit Number AL0072281, for reissuance of a permit which limits the discharge of pollutants from filter backwash from South Parkway WTP, 14000 Memorial Parkway, Huntsville, Alabama 35803, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of filter backwash to Aldridge Creek, classified as Fish & Wildlife, in the Tennessee River Basin.

MONTGOMERY COUNTY

The Water Works & Sanitary Sewer Board of the City of Montgomery, Post Office Box 1631, Montgomery, AL 36102, NPDES Permit Number AL0082431, for reissuance of a permit which limits the discharge of pollutants from domestic wastewater from Milley’s Creek WPCP, 1491 Alexander Road, Pike Road, AL 36064, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Tallapoosa River, a waterway classified as Public Water Supply and Fish & Wildlife, in the Tallapoosa River Basin.

SUMTER COUNTY

Sumter County Sewer Authority, Post Office Box 115, Emelle, AL 35459, NPDES Permit Number AL0080306, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Wendy Hills Lagoon, Wendy Hills Road, Gainesville, AL 35464, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Toms Creek, classified as Fish and Wildlife, in the Upper Tombigbee River Basin.

TUSCALOOSA COUNTY

The City of Northport, 3950 3rd Street South, Northport, AL 35476, NPDES Permit Number AL0064394, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from the Northport WWTP, 3950 3rd Street South, Northport, AL 35476, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Mill Creek, classified as Fish and Wildlife, in the Black Warrior River Basin and stormwater runoff to the Black Warrior River (Warrior Lake), classified as Fish and Wildlife, in the Black Warrior River Basin.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
