PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to enter into an Order of Consent with MRC-FG, LLC, which operates a coal processing facility known as Mine No. 7 Preparation Plant. The entrance to the facility is located at 18069 Hannah Creek Road, Brookwood, Tuscaloosa County, Alabama.   

The Order addresses AWPCA and NPDES permit violations for discharge of pollutants from point sources identified in the Permit; failure to prevent discharges that caused visible turbidity in waters of the State; and failure to meet permit limitations.

The Department is proposing a civil penalty in the amount of $25,011. The Order, if executed, would require MRC-FG, LLC to pay the proposed civil penalty; to continue to submit reports associated with its progress towards achieving compliance with an existing Remediation Plan; and to submit certification by a Professional Engineer licensed to practice in Alabama indicating compliance with all requirements of the Order.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Jeffery W. Kitchens, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
