PROPOSED ORDER
Madison County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Technicolor Home Entertainment Services Southeast LLC (EPA Identification Number ALD982098311), which owned/operated a DVD packaging facility located at 4905 Moores Mill Road in Huntsville, Madison County, Alabama.
The violations consisted of the following: failure to prevent unknowing entry into hazardous waste storage areas, failure to post required “No Smoking” signs, failure to post required "Danger--Unauthorized Personnel Keep Out" signs, failure to mark hazardous waste containers with the words “Hazardous Waste”, failure to mark hazardous waste containers with an indication of the hazards, failure to mark hazardous waste containers with an accumulation start date, failure to provide for review all manifests for the previous three years, failure to conduct and document weekly inspections of all areas where hazardous waste is stored, failure to provide training records for employees that handle hazardous waste, failure to provide a waste minimization plan for review, failure to provide documentation that the facility’s contingency plan had been sent to all local emergency responders, failure to provide for review the job title for each position that handles hazardous waste, failure to provide for review the job description for each position that handles hazardous waste, failure to provide a written description of the type and amount of training needed for each person that handles hazardous waste, and failure to obtain a permit prior to storing hazardous waste.
The Department is proposing a civil penalty in the amount of $13,320. The Order, if issued, would require Technicolor Home Entertainment Services Southwest LLC to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Stephen A. Cobb, Chief of the Land Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
