NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

CHILTON COUNTY

Stella-Jones Corporation, 100 McKinney Drive, Clanton, AL 35045, NPDES Permit Number AL0080543, located at the same address, for reissuance of a permit, which authorizes discharges resulting from storm water associated with wood treating operations involving Creosote and Borate through DSN002, DSN003, and DSN004 to Gum Creek, classified as Fish and Wildlife, in the Coosa River Basin.

JACKSON COUNTY

WestRock CP, LLC - Stevenson Mill, PO Box 508, Stevenson, AL 35772, NPDES Permit Number AL0022314, located at 1611 County Road 85, Stevenson, AL 35772, for reissuance of a permit, which authorizes discharges resulting from process wastewater from paperboard manufacturing, landfill leachate, and stormwater associated with industrial activity through DSN001 and treated sanitary wastewater through DSN002 to Tennessee River, classified as Public Water Supply, Swimming and other Whole Body Contact Sports, Fish & Wildlife; landfill leachate and stormwater associated with industrial activity through DSN005, stormwater associated with industrial activity through DSN006 and DSN022, and process discharges associated with exterior rail car washing operations and stormwater runoff from industrial activity through DSN023 to an unnamed tributary to Tennessee River, classified as Fish & Wildlife; stormwater and contact water from wet decking operations through DSN024 and stormwater associated with areas around wet decking operations through DSN025 to an unnamed tributary to Bengis Creek, classified as Fish & Wildlife, all located in the  Tennessee River Basin.  At this time, the Department has made a Best Professional Judgment (BPJ) determination that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

JEFFERSON COUNTY

Bluestone Coke, LLC, 3500 35th Avenue North, Birmingham, AL 35207, NPDES Permit Number AL0003247, located at the same address, for reissuance of a permit, which authorizes discharges resulting from wastewater from DSN01B (process wastewater from the coke-plant, by-products plant, and steam traps, process area storm water, and sanitary wastewater), non-contact cooling water, boiler blowdown, dust control and coal pile runoff, and storm water from plant areas through DSN001 to Five Mile Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

DE KALB COUNTY

Justice Coal of Alabama, LLC – Poore Mine, PO Box 2178, Beaver, West Virginia 25813, NPDES Permit Number AL0078867, located on County Road 167, Ider, DeKalb County, Alabama, for issuance of a permit that limit discharges from a dry preparation coal mining operation, and associated area, discharging to Miller Creek, and an unnamed tributary to Miller Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

MS Industries II, LLC – Masterson Site, 101 N. Jackson Ave., Russellville, Alabama 35653, NPDES Permit Number AL0082759,located at 2228 County Road 135, Town Creek, Lawrence County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation dirt and/or chert, sandstone, shale and common clay, and bauxitic clay mining operation and associated areas, discharging to an unnamed tributary to Hagwood Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

LIMESTONE COUNTY

Rogers Group, Inc. - West Huntsville Quarry, 421 Great Circle Road, Nashville, Tennessee 37228, NPDES Permit Number AL0083089,located on Gray Road, Madison, Limestone County, Alabama, for modification of a permit that limits discharges of treated drainage from a wet and dry preparation limestone quarry and associated areas, discharging to Martin Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

MARSHALL COUNTY

Reed Contracting Services, Inc. – Reed Sand and Gravel Pit, 2512 Triana Boulevard, SW, Huntsville, Alabama 35805, NPDES Permit Number AL0082490, located on Feemster Gap Road, Gunterville, Marshall County, Alabama, for issuance of a permit that limit discharges from a wet and dry preparation sandstone quarry and associated areas, discharging to Red Hill Branch, classified as Fish and Wildlife, in the Black Warrior River Basin.

Maddox Clay Pit, 3024 Acme Brick Plaza, Fort Worth, Texas 76109, NPDES Permit Number AL0068071, located at 3400 Jackson Ferry Road, Montgomery, Montgomery County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a shale and/or common clay mine and associated areas, discharging to unnamed tributaries to the Alabama River, classified as Fish and Wildlife, in the Alabama River Basin.

White Rock Quarries, LLC – Vincent Hills Quarry, 101 Sansbury's Way, West Palm Beach, Florida 33411, NPDES Permit Number AL0082066,located at 4324 Highway 85, Vincent, Shelby County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation limestone quarry and associated areas, discharging to the Coosa River (Lay Lake), classified as Public Water Supply, Swimming and Other whole Body Water- Contact Sports, and Fish and Wildlife, unnamed tributaries to Spring Creek, and unnamed tributaries to Locust Creek, classified as Fish and Wildlife, in the Coosa River Basin.

St Clair County Economic Development Council – St Clair EDC Chert Pit, 500 College Circle Suite 306, Pell City, Alabama 35125, NPDES Permit Number AL0083615, located at 7014 Veterans Pkwy, Pell City, St Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dirt and/or chert mine and associated areas, discharging to Dunlop Spring Branch, classified as Fish and Wildlife, in the Coosa River Basin.

The subject permit regulates the discharge of treated wastewater to Caffee Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

BLOUNT COUNTY

Town of Snead, PO Box 505, Snead, AL 35952, NPDES Permit Number AL0058572, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Snead WWTP, 400 Industrial Park Drive, Snead, AL 35952, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Locust Fork, classified as Fish & Wildlife, in the Black Warrior River Basin.

DALE COUNTY

The Utilities Board of the City of Ozark, PO Box 1125, Ozark, AL 36361, NPDES Permit Number AL0056324, for reissuance of a permit which limits the discharge of pollutants from treated domestic and stormwater runoff from the Ozark Southside WWTF, Alabama Highway 123, Ozark, AL, 36361, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Klondike Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

DALLAS COUNTY

Jimmy Dwayne Duke, 148 Laurie Lane, Marion Junction, AL 36759, NPDES Permit Number AL0045861, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Mary’s Place, 12278 Alabama Highway 14 West, Valley Grande, AL 36701, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Tate Branch, classified as Fish and Wildlife, in the Cahaba River Basin.

The Dallas County Commission, PO Box 987, Selma, AL 36702, NPDES Permit Number AL0048151, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Delwood HCR Lagoon, Dallas County Road 911, Orrville, AL, 36767 for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Bogue Chitto Creek, classified as Fish and Wildlife, in the Alabama River Basin.

FAYETTE COUNTY

Fayette County Board of Education, PO Box 686, Fayette, AL 35555, NPDES Permit Number AL0051322, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Hubbertville School WWTP, 7360 County Road 49, Fayette, AL 35555, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Sipsey River, classified as Fish and Wildlife, in the Tombigbee River Basin.

GREENE COUNTY

City of Eutaw, PO Box 431, Eutaw, AL 35462, NPDES Permit Number AL0044067, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from City of Eutaw Lagoon, Bull Run Rd, Eutaw, AL 35462, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Black Warrior River (Lake Demopolis), classified as Fish and Wildlife, in the Black Warrior River Basin.

JEFFERSON COUNTY

Jefferson County Commission, 716 Richard Arrington Jr. Blvd. N., Suite 300A, Birmingham, AL 35203, NPDES Permit Number AL0050881,for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Warrior WRF, 700 Blackburn Lane, Warrior, AL 35180, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Cane Creek, classified as Fish & Wildlife, in the Cahaba River Basin.

Lockerbie Homeowners Association, 4 Office Park Circle, Birmingham, AL 35223, NPDES Permit Number AL0047571,for reissuance of a permit which limits the discharge of pollutions from treated domestic wastewater from Lockerbie Subdivision WWTP, Overton Road, Birmingham, AL 35223 for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Little Shades Creek, classified as Fish & Wildlife, in the Cahaba River Basin.

MONTGOMERY COUNTY

The Water Works & Sanitary Sewer Board of the City of Montgomery, PO Box 1631, Montgomery, AL 36102, NPDES Permit Number AL0027863, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater, and storm water runoff from Catoma Creek WWTP, 6000 Richard E. Hanan Drive, Montgomery, AL 36108, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water runoff to the Alabama River (Woodfuff Lake) and Antioch Branch, waterways classified as Fish & Wildlife, in the Alabama River Basin.

PICKENS COUNTY

Town of Carrollton, PO Box 169, Carrollton, AL 35447, NPDES Permit Number AL0020907, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Carrollton Lagoon, Latham Street, Carrollton, AL 35447, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to a Lubbub Creek, classified as Fish and Wildlife, in the Tombigbee River Basin.

 

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
