NOTICE OF PROPOSED UNILATERAL ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-16 (2006 Rplc. Vol.), the Alabama Department of Environmental Management is proposing to issue a Unilateral Order to the City of East Brewton Water and Sewer Board (PWSID AL0000558), which operates a public water system under Public Water Supply Permit 2016-813, located at 615 Forrest Ave. in East Brewton, Escambia County, Alabama.

The violations consist of failure to complete the 2018 Consumer Confidence Report requirements by the July 1, 2019 deadline and a November 2018 Revised Total Coliform Rule reporting violation.

The Department is proposing a civil penalty in the amount of $7,920.00.  The Order, if issued, would require payment to the Department in twelve equal monthly installments, beginning with the first full calendar month after issuance of the Order.  

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Jeffery W. Kitchens, Chief of the Water Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.

This notice is hereby given this 20th day of November, 2019, by authorization of the Alabama Department of Environmental Management.
