NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Baldwin Pole and Piling Co., Inc., at 310 Highway 112, Bay Minette, AL 36507, NPDES Permit Number AL0066362, located at same address, for reissuance of a permit which limits existing discharges resulting from stormwater associated with lumber and wood products industry including wood treating operations using chromated copper arsenate., discharging through DSN001; stormwater associated with lumber and wood products industry including wood treating operations using chromated copper arsenate., discharging through DSN002; and stormwater associated with lumber and wood products industry including wood treating operations using chromated copper arsenate, penta-treated pole storage areas and petroleum fueling areas, discharging through DSN003. DE KALB COUNTY

YS, Inc., at 4531 County Road 458, Collinsville, AL 35961, NPDES Permit Number AL0084034, located at 6001 Gault Ave N, Fort Payne, AL 35967, for initial issuance of a permit which limits new discharges resulting from stormwater runoff associated with industrial activities which may include bottling and packaging of poultry supplements, rail to bulk trailer trans loading and non-bulk unloading, and blending and rail transfer through DSN001 to Unnamed Tributary to Big Wills Creek classified as Fish and Wildlife, in the Coosa River Basin.

JEFFERSON COUNTY

Reno Refractories, Inc., PO Box 201, Morris, AL 35116, NPDES Permit Number AL0081892, located at 601 Reno Drive, Morris, AL 35116, for reissuance of a permit, which limits existing discharges resulting from process wastewater resulting from rock washing operations through DSN001 and process wastewater resulting from cement mixing and blending wash down operations through DSN002 discharging into Turkey Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

MARSHALL COUNTY

Hyco Alabama LLC, PO Box 7, Arab, AL 35016 , NPDES Permit Number AL0065111, located at 218 Arad Thompson Road, Arab, Alabama 35016, for reissuance of a permit which limits existing discharges resulting from Storm water runoff associated with electroplating and metal finishing operations through DSN002 and DSN003 to Shoal Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

MOBILE COUNTY

Mobile County Commission, at 205 Government St, Mobile, AL 36644, NPDES Permit Number AL0076376, located at North Mobile County Industrial Park, US Highway 43 North, Axis AL 36505, for reissuance of a permit which limits existing discharges resulting from storm water runoff associated with a closed landfill operation, discharging through DSN004 into an Unnamed Tributary to Cold Creek, classified as Fish & Wildlife, located in the Mobile River Basin.

Water and Waste Specialties LLC, PO Box 746, Theodore, AL 36582, NPDES Permit AL0084077, located at 5275 1-10 Industrial Parkway South, Theodore AL 36582, for reissuance of a permit which limits new discharges resulting from stormwater from the sale and distribution of waste water treatment chemicals, discharging through DSN001 into an Unnamed Tributary to Rabbit Creek, classified as Fish & Wildlife, in the Mobile River Basin.

ST CLAIR COUNTY

TCI of Alabama, LLC, 101 Parkway East, Pell City, AL 35125, NPDES Permit Number AL0082601, located at the same address, for reissuance of a permit, which limits existing discharges resulting from stormwater from salvaging and recycling of electrical equipment containing PCBs through DSN001 and new discharges from stormwater from salvaging and recycling of electrical equipment containing PCBs through DSN002 discharging into an Unnamed Tributary to Fishing Creek, classified as Fish and Wildlife, in the Coosa River Basin.

WALKER COUNTY

Dyno Nobel, Inc., at 8425 Highway 269, Parrish, AL 35580, NPDES Permit AL0083810, located at same address, for initial issuance of a permit which limits existing discharges resulting from uncontaminated railcar condensate and industrial stormwater associated with blasting agents manufacturing, discharging through DSN001; Uncontaminated railcar condensate, uncontaminated compressor condensate, incidental non-contact cooling water/cooling tower blowdown/ boiler blowdown, exterior vehicle wash water, and industrial stormwater associated with blasting agents manufacturing, discharging through DSN002; and Industrial stormwater associated with blasting agents manufacturing, discharging through DSN003. Each outfall discharges to Unnamed Tributary to Bryants Creek, classified as Fish & Wildlife, in the Black Warrior River Basin.

Bedwell Whorton Excavating, LLC – Bedwell Whorton Chert Pit, 718 West Grand Avenue,  Rainbow City, Alabama 35906, NPDES Permit No. AL0068683, located on Alabama Highway 77, Attalla, Etowah County, Alabama 35954, for issuance of a permit that limits discharges of treated drainage from a dirt and/or chert mine and associated areas, discharging to Groundwater and unnamed tributaries to Big Wills Creek, classified as Fish and Wildlife, in the Coosa River Basin.

Carbo Ceramics, Inc. – Carbo-Bell Bauxite Pit, 36 Arch Drive, Eufaula, Alabama 36027, NPDES Permit No. AL0082171, located on County Road 86, Abbeville, Henry County, Alabama 36310, for issuance of a permit that limits discharges of treated drainage from a bauxitic clay mine and associated areas, discharging to an unnamed tributary to Billy Branch Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

City of Clio, PO Box 219, Clio, AL 36017, NPDES Permit Number AL0067181, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Clio Lagoon, Alex Shipman Road, Clio, AL 36017, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Pea River, a waterway classified as Fish & Wildlife, in the Choctawhatchee River Basin.

CHEROKEE COUNTY

Guthrie & Associates, Inc., 4217 Harpers Ferry Road, Birmingham, AL 35213, NPDES Permit Number AL0083879, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Lawrence Landing Subdivision WWTP, County Road 189, Cedar Bluff, AL 35959, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Coosa River (Weiss Lake), a waterway classified as Swimming, and Fish & Wildlife, in the Coosa River Basin.

LAWRENCE COUNTY

West Morgan East Lawrence Water and Sewer Authority, 2547 Kirby Bridge Road, Decatur, Alabama 35609, NPDES Permit Number AL0077020, for revoke and reissuance of a permit which limits the discharge of pollutants from filter backwash and reverse osmosis from Robert M. Hames WTP, 6505 County Road 400, Hillsboro, Alabama 35643, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of filter backwash and reverse osmosis to the Tennessee River (Wheeler Lake), classified as Public Water Supply, Swimming, and Fish & Wildlife, in the Tennessee River Basin.

LIMESTONE COUNTY

Limestone County Water and Sewer Authority, PO Box 110, Athens, Alabama 35612, NPDES Permit Number AL0048461, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Limestone Correctional Facility Lagoon, 28779 Nick Davis Road, Harvest, Alabama 35749, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Limestone Creek, classified as Fish & Wildlife, in the Tennessee River Basin.

MOBILE COUNTY

Mobile Area Water and Sewer System, PO Box 180249, Mobile, Alabama 36618, NPDES Permit Number AL0023086, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and storm water runoff from Clifton C. Williams WWTP, located at 1600 Yeend Street, Mobile, Alabama 36603, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water runoff to Mobile Bay, classified as Fish & Wildlife, in the Mobile River – Mobile Bay Basin.

ST CLAIR COUNTY

Village at Cook Springs, LLC, 415 Cook Springs Road, Pell City, AL 35125, NPDES Permit Number AL0049051, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Village at Cook Springs, 415 Cook Springs Road, Pell City, AL 35125 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Cane Creek, classified as Fish & Wildlife, in the Coosa river Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
