PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Patrick F. Kelly, Jr. and Sandra M. Kellyfor failure to close an unauthorized dump and an unauthorized scrap tire accumulation located at 1864 County Road 610 in Enterprise, Coffee County, Alabama.
The violations consisted of Patrick F. Kelly, Jr. and Sandra M. Kelly creating and not properly closing an unauthorized dump and an unauthorized scrap tire accumulation.
The Department is proposing a civil penalty in the amount of $10,000. The Order, if issued, would require Patrick F. Kelly, Jr. and Sandra M. Kelly to cease and desist the operation of the unauthorized dump and unauthorized scrap tire accumulation, and to submit an abatement plan to the Department. This plan would require the removal and proper disposal of all regulated wastes, and a schedule for abatement completion.
Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to the Alabama Department of Environmental Management, attention Stephen A. Cobb, Chief of the Land Division, P.O. Box 301463, Montgomery, Alabama 36130-1463. The comment period shall end at the close of business 30 days from the publication date of this notice.
