NOTICE OF PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17 as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to the Evonik Corporation, the owner/operator of a chemical manufacturing facility currently operating in Theodore, Alabama.
The violation consisted of the failure to route methanol storage tank S-404 to the closed vent system associated with the North Thermal Oxidizer (I-0330) as required under Proviso #6 of the Emission Standards Section of the Sodium Methylate VOC Storage Tanks (Emission Unit 4.2T) for the period January 31, 2018 through March 1, 2019.
The Department is proposing a civil penalty in the amount of $40,000. The Order, if issued, would require the Evonik Corporation to operate in compliance with ADEM Admin. Code 335-3 and all conditions and requirements of the Major Source Operating Permit.

The comment period shall end at the close of business 30 days from the publication date of this notice. A copy of the proposed Order is available on the ADEM web page at http://adem.alabama.gov/compInfo/adminOrders.cnt, or may be obtained by written request to the above address. A nominal fee for copying may be charged.
