NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

CULLMAN COUNTY

Louisiana Pacific Corporation, 902 Main St SE, Hanceville, Alabama 35077, NPDES Permit Number AL0080063, located at the same address, for reissuance of a permit which limits the existing discharges resulting from RTO wash water, storm water from product test stands, and storm water from wet decking operations, discharging through DSN001; storm water associated with wood and lumber products industry discharging through DSN002; and storm water associated with wood and lumber products industry discharging through DSN03. Each outfall discharges to an unnamed tributary to Mud Creek, classified as Fish and Wildlife, and is located in the Black Warrior River Basin.

Hocking International Laboratories, LLC, 171 Gene E Stewart Court, Sylacauga, Alabama 35151, NPDES Permit Number AL0083992, located at same address, for initial issuance of a permit which limits new discharges resulting from storm water runoff from fertilizer, pesticide, and industrial cleaning chemical blending operations, discharging through outfalls DSN001 and DSN002 to Tar Water Branch, classified as Fish & Wildlife, in the Coosa River Basin.

The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Mulberry Creek, classified as Fish and Wildlife, in the Alabama River Basin.

The Water Works and Sewer Board of the City of Gadsden, P O Box 800, Gadsden, Alabama 35902, NPDES Permit Number AL0083844, for issuance of a permit which limits the discharge of pollutants from filter backwash from Gadsden Water Filtration Plant, 625 Albert Rains Boulevard, Gadsden, Alabama 35901, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of filter backwash to the Coosa River (Neely Henry Lake), classified as Fish and Wildlife, in the Coosa River Basin.

Lee County Board of Education, 2410 Society Hill Road, Opelika, Alabama 36804, NPDES Permit Number AL0043664, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Beulah High School Lagoon, 4848 Lee Road 270, Valley, Alabama 36854, for purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Halawakee Creek (Lake Harding), a waterway classified as Fish & Wildlife, in the Chattahoochee River Basin.

Water Works and Sewer Board of the Town of Ardmore, Post Office Box 26 , Ardmore, Tennessee 38449, NPDES Permit Number AL0023329, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ardmore WWTP, 29529 Jones Avenue, Ardmore, Alabama 35739, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Piney Creek, classified as Fish & Wildlife, in the Tennessee River Basin.

MONTGOMERY COUNTY

Montgomery Water Works & Sanitary Sewer Board, Post Office Box 1631, Montgomery, Alabama 36102, NPDES Permit Number AL0022225, for reissuance of a permit which limits the discharge pf pollutants from treated domestic wastewater and industrial wastewater, and storm water runoff from the Econchate WWTP, 2501 Jackson Ferry Road, Montgomery, Alabama 36104, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water runoff to the Alabama River (Woodruff Lake), a waterway classified as Fish & Wildlife, in the Alabama River Basin.

The Shoal Creek Country Club, 100 New Williamsburg Drive, Shoal Creek, Alabama 35242, NPDES Permit Number AL0049891, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Shoal Creek Country Club WWTP, 100 New Williamsburg Drive, Shoal Creek, Alabama 35242, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Shoal Creek, classified as Fish and Wildlife, in the Coosa River Basin.

ST CLAIR COUNTY

Enviro Management Company, Inc., 2607 Commerce Boulevard, Birmingham, Alabama 35210, NPDES Permit Number AL0052281, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Harbortown Townhouse STP, Fraim Drive, Cropwell, Alabama 35054 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Easonville Creek (Logan Martin Lake), classified as Swimming/Fish & Wildlife, in the Coosa River Basin.

TALLADEGA COUNTY

Utilities Board of the City of Sylacauga, Post Office Box 207, Sylacauga, Alabama 35150, NPDES Permit Number AL0020010, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Fairmont WWTP, 885 Brooks Road, Sylacauga, Alabama 35150, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Tallasseehatchee Creek, a waterway classified as Fish & Wildlife, in the Coosa River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final permit determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
