NOTICE OF PROPOSED SOLID WASTE PERMIT RENEWAL UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Mobile County

Brownlee Landfill, LLC has applied for a permit renewal and a variance to the construction and demolition waste landfill known as the Brownlee Landfill (Permit No. 49-22). The variance requested is from Rule 335-13-4-.12(2)(f) requiring a 100 foot buffer. The variance is granted for all existing waste already disposed of in the buffer zone. No further disposal shall take place within 100 feet of the permitted boundary. The approved waste stream for the Brownlee Landfill will remain nonputrescible and nonhazardous construction and demolition waste and rubbish as defined by Rule 335-13-1-.03. and discarded tires. The service area for Brownlee Landfill will remain Mobile County in Alabama. The maximum average daily volume of waste disposed at the Brownlee Landfill will remain 285 cubic yards per day. All previously approved variances have been requested and shall remain in the permit.

The Brownlee Landfill is described as being SW ¼ of Section 15, Township 3 South, and Range 2 West, on Henry Road in Mobile County, Alabama. The Brownlee Landfill has a permitted area of approximately 20 acres with all approved for disposal.

Copies of the landfill application form and proposed permit are available for public inspection electronically via the ADEM website at http://adem.alabama.gov/newsEvents/publicNotices.cnt and the complete application at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above within 35 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
