NOTICE OF AN EMERGENCY PERMIT FOR THE UNITED STATES DEPARTMENT OF THE ARMY, US ARMY GARRISON – REDSTONE, UNDER THE ALABAMA HAZARDOUS WASTES MANAGEMENT AND MINIMIZATION ACT (AHWMMA) AND REQUEST FOR COMMENTS

MADISON COUNTY

The Alabama Department of Environmental Management (ADEM) has issued an emergency permit authorizing the open detonation or open burning of 300 pounds of ammonium nitrate mixed with 1 percent zinc oxide and 2 percent unknown substance, 4,305 grams titanium powder and 1,175 grams magnesium powder that is currently stored at the Redstone Arsenal (RSA), EPA Identification No. AL 7 210 020 742.  The waste compounds will be destroyed by thermal treatment, open detonation or open burning, at Test Area 1 (TA-1).

Under ADEM Administrative Code R. 335-14-8-.06(1), an emergency permit is warranted when there is an imminent and substantial danger to human health and the environment.  The compounds have been determined to be unstable and unsuitable for usage or testing, and no other viable treatment alternatives have been identified.  In addition, RSA’s permitted Subpart X Open Burning (OB) treatment unit and Subpart X Open Detonation (OD) treatment unit is closed for construction until weather conditions allow for earth fill placement.  The treatment described in the permit was determined to be the safest and most effective technology available.  ADEM has issued this permit for a duration of two weeks.

Copies of the permit request, fact sheet, statement of basis and emergency permit are available for public inspection electronically via http://www.adem.alabama.gov/newsEvents/publicNotices.cnt and at the following location Monday – Friday (except legal holidays) during the hours of 8:00 a.m. to 5:00 p.m.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 45 days of the publication date of this notice.  Comments must address issues that have an impact on the applicant's ability to comply with applicable environmental laws, rules and regulations.  All comments received within the 45-day period will be considered in the formulation of future permits of this type.
