Dale County

Arichem, LLC, NPDES Permit Number AL0066770, located at 187 Sloss Industries Road, Ariton, Alabama, 36311 for re-issuance of existing discharges resulting from storm water runoff from industrial activities, discharging through outfall DSN001 to an Unnamed Tributary to Bear Creek, classified as Fish & Wildlife, in the Choctawhatchee River Basin.

Marshall County

Pilgrim’s, Inc., Guntersville Processing Plant, NPDES Permit Number AL0082384, located at 3500 Lake Guntersville Park Drive, Guntersville, Alabama 35976 for reissuance of the existing discharges resulting from storm water runoff associated with poultry processing, discharging through outfalls DSN001Q-DSN005Q to Lake Guntersville, classified as Public Water Supply, Swimming, and Fish and Wildlife, in the Tennessee River Basin.

Morgan County

Nucor Steel Decatur, LLC, NPDES Permit Number AL0070068, located at 4301 Iverson Boulevard, Trinity, Alabama 35673, for a modification of existing discharges resulting from non-contact cooling water and stormwater runoff associated with steel mill operations discharging through Outfalls DSN001 and DSN002 into an unnamed tributary of the Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin; non-contact cooling water blowdown, reverse osmosis concentrate, softener backwash, carbon filter backwash, and stormwater runoff associated with steel mill operations discharging through Outfall DSN007 into an unnamed tributary of the Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin; stormwater runoff associated with steel mill operations discharging through Outfalls DSN003, DSN011, DSN012 into an unnamed tributary of the Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin; stormwater runoff associated with steel mill operations discharging through Outfall DSN004 into the Tennessee River, classified as Public Water Supply, Swimming, and Fish & Wildlife, in the Tennessee River Basin.  The Department has determined that the entity providing cooling water to the Permittee is a public water system in accordance with Section 1401 of the Safe Drinking Water Act; therefore, the Permittee is exempt from the requirements of Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and rules adopted under this section.

Town of Midway, Post Office Box 36, Midway, AL 36053, NPDES Permit Number AL0070726, for re-issuance of a permit which limits the pollutants from treated domestic wastewater from Midway Land Application, Bullock County Highway 47, Midway, AL 36053, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to a Sprayfield, in the Chattahoochee River Basin.

Calhoun County

Calhoun County Board of Education, Post Office Box 2084, Anniston, AL 36202, NPDES Permit Number AL0055549, for re-issuance of a permit which limits the pollutants from treated domestic wastewater from Alexandria School WWTP, 353 Stadium Drive, Alexandria, AL 36250, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Alexandria Creek, classified as Fish & Wildlife, in the Coosa River Basin.

Colbert County

Colbert County Rural Water System, 2750 Higway 20, Tuscumbia, AL 35674, NPDES Permit Number AL0075515, for re-issuance of a permit which limits the pollutants from filter backwash from Colbert County WTP, 16531 Highway 72, Tuscumbia, AL 35674, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of filter backwash to the Tennessee River (Pickwick Lake), classified as Public Water Supply, Swimming, and Fish & Wildlife, in the Tennessee River Basin.

Talladega County

City of Talladega Water and Sewer, 100 North Court Street, Talladega, AL 35160, NPDES Permit Number AL0022349, modification of a permit which limits the pollutants from treated domestic and industrial wastewater from Talladega Brecon WWTP, 525 Welch Avenue, Talladega, AL 35160, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Kelly Creek, a waterway classified as Fish & Wildlife, in the Coosa River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
