PROPOSED CONSENT ORDER
Lowndes County
Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to enter into an Order of Consent with Alabama Sand and Gravel, Inc., which operates a facility known as Meadows Pit located in Lowndes County, Alabama. The entrance to the mine is located on County Road 40, Lowndesboro, Lowndes County, Alabama.
The Order addresses AWPCA and NPDES permit violations for failure to conduct routine inspections at the required frequency; failure to maintain a written log of required inspections; failure to summarize monitoring results on a DMR; failure to provide an updated PAP Plan; failure to implement the requirements of the PAP Plan; failure to submit non-compliance forms; failure to route all discharges through a certified outfall; failure to conduct operations in a manner as to minimize their impact on water quality; failure to conduct mining in a manner as to leave a 50-foot setback; and conducting operations such that sediment is placed in a stream.
The Department is proposing a civil penalty in the amount of $85,000. The Order, if executed, would require Alabama Sand and Gravel, Inc. to pay the proposed civil penalty and prepare an Engineering Report identifying potential causes of noncompliance and summarizing the changes necessary for the Permittee to achieve compliance with State and federal regulations.
