PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Irby M. Jr. and Shirley A. Scogin for failure to close an unauthorized solid waste dump located at 2900 Roberts Mill Pond Road in Pell City, St. Clair County, Alabama.

The violations consisted of Irby M. Jr. and Shirley A. Scogin creating and not properly closing an unauthorized solid waste dump. 

The Department is proposing a civil penalty in the amount of $5000.  The Order, if issued, would require Irby M. Jr. and Shirley A. Scogin to cease and desist the operation of the unauthorized solid waste dump, and to submit an abatement plan to the Department.  This plan would require the removal and proper disposal of all regulated wastes, and a schedule for abatement completion.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:

This notice is hereby given this 25th day of June, 2020, by authorization of the Alabama Department of Environmental Management.
