Pharmavite, LLC - Pharmavite East Coast Manufacturing Facility, 4701 Northpark Drive, Opelika, Alabama 36801, NPDES Permit Number AL0082651, located at same address, for reissuance of a permit which limits existing discharges resulting from storm water runoff from pharmaceutical manufacturing operations, discharging through outfalls DSN001 and DSN002 to an unnamed tributary to Halawakee Creek, classified as Fish & Wildlife, in the Chattahoochee River Basin.

The Alabama Department of Environmental Management has made a tentative decision to deny the request for Justice Coal of Alabama, LLC - Poore Mine, PO Box 2178, Beaver, West Virginia 25813, NPDES Permit Number AL0078867, located on County Road 167, Ider, DeKalb County, Alabama 35981, for reissuance of a permit that limits discharges from a dry preparation coal mining and associated areas, discharging to Miller Creek, and an unnamed tributary to Miller Creek, classified as Fish and Wildlife, in the Tennessee River Basin. This denial is based on the facility’s submittal of an incomplete application associated with the requirements of ADEM Admin. Code ch. 335-6-6.

JP Rice Trucking, LLC - Hollywood Chert Pit, 6075 County Road 33, Hollywood, Alabama 35752, NPDES Permit Number AL0078379, located on 26 Coffee Street, Hollywood, Jackson County, Alabama 35752, for reissuance and modification of a permit that limits discharges of treated drainage from a dirt and/or chert mine and associated areas, discharging to an unnamed tributary to Dry Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

Whitaker Contracting Corp. - Jackson County Quarry, PO Box 306, Guntersville, Alabama 35976, NPDES Permit Number AL0082856, located on County Road 174, Flat Rock, Jackson County, Alabama 35966, for reissuance and modification of a permit that limits discharges treated drainage from a wet preparation sandstone quarry with incidental dirt/chert mining and associated areas, discharging to Ross Branch, an unnamed tributary to Ross Branch, and an unnamed tributary to Gordon Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

Upper Bear Creek Water, Sewer, and Fire Protection District, PO Box 326, Haleyville, AL 35565, NPDES Permit Number AL0052311, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Upper Bear Creek WTP, 339 County Road 62, Bear Creek, Alabama 35543, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of filter backwash to an Unnamed Tributary to Bear Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

MOBILE COUNTY

South Alabama Utilities, PO Box 428, Citronelle, Alabama 36522, NPDES Permit Number AL0083895, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from McLeod Road WWTP, located at McLeod Road, Mobile, Alabama 36695, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Miller Creek, classified as Fish & Wildlife, in the Escatawpa River Basin.

ST CLAIR COUNTY

Paradise Isle Condominium Association, 300 Paradise Isle, Riverside, AL 35135, NPDES Permit Number AL0050385, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Paradise Isle Condominiums WWTP, 300 Paradise Isle, Riverside, Alabama 35135, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Coosa River (Logan Martin Lake), classified as Swimming/Fish & Wildlife, in the Coosa River Basin.

WALKER COUNTY

City of Cordova, 3885 N Massachusetts Ave Suite 103, Cordova, AL 35550, NPDES Permit Number AL0020427, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cordova WWTP, Walker County Road 30, Cordova, Alabama 35550, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Mulberry Fork, classified as Public Water Supply and Fish and Wildlife, in the Black Warrior River Basin.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
