NOTICE OF PROPOSED MODIFICATION TO THE HAZARDOUS WASTE FACILITY/SUBPART X/SWMU CORRECTIVE ACTION PERMIT UNDER THE ALABAMA HAZARDOUS WASTES MANAGEMENT AND MINIMIZATION ACT (AHWMMA) AND REQUEST FOR COMMENTS

Madison County

U.S. Army Garrison – Redstone Arsenal (RSA) of Redstone Arsenal, Alabama submitted to ADEM applications for modification of its Alabama Hazardous Wastes Management and Minimization Act (AHWMMA) – Hazardous Waste Facility permit.  The permit consists of the Hazardous Waste Storage Facility (33 storage igloos), Subpart X Open Burning (OB) Unit and Subpart X Open Detonation (OD) Unit and Solid Waste Management Units/Areas of Concern (SWMUs/AOCs) that are used to manage hazardous waste at its facility (EPA I.D. Number AL7 210 020 742) located in Huntsville, Madison County, Alabama.  The Department has determined that the facility’s modification applications are complete and has prepared a draft permit modification in accordance with State regulations.
                           
RSA operates a facility that treats and stores hazardous waste.  The hazardous waste treatment and storage facility consists of a hazardous waste storage area (33 storage igloos), a Subpart X Open Burning (OB) treatment unit, a Subpart X Open Detonation (OD) treatment unit and solid waste management units (SWMUs) and areas of concern (AOCs).  RSA is the owner and operator of the facility.  This proposed permit modification includes changes to the signatories in the Part A permit application and changes to the EPA Region 4 contact.  The corrective measures at RSA-142 have been revised.  The CMIs planned at RSA-003, RSA-009, RSA-056/RSA-139, RSA-083, RSA-140, RSA-201/RSA-242/RSA-247 and MSFC-033A have been added.  The Phase II CMI plan for RSA-058 has been included in this permit modification.  SWMUs RSA-135H, RSA-156, RSA-157, RSA-208, RSA-218, RSA-221, RSA-230, RSA-234, RSA-262, RSA-283, RSA-312 and RSA-313 were moved from the table indicating that an investigation is required to the table indicating that corrective measures are needed.  In the proposed modification, SWMUs RSA-216 and RSA-241 were moved to the table that indicates no further action is needed at this time.

Copies of the fact sheet, the request to change the Part A permit application, the CMI plans for RSA-003, RSA-009, RSA-056/RSA-139, RSA-083, RSA-140, RSA-201, RSA-242, RSA-247 and MSFC-033A and the Phase II CMI for RSA-058 and the addendum for RSA-095 and RSA-142, along with the draft, modified AHWMMA permit are available for public inspection electronically via http://www.adem.alabama.gov/newsEvents/publicNotices.cnt
and at the following location Monday – Friday (except legal holidays) during the hours of 8:00 a.m. to 5:00 p.m.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 45 days of the publication date of this notice.  To affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit modification.

A written request for a public hearing may also be filed within the 45-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the AHWMMA, the federal Resource, Conservation and Recovery Act (RCRA) and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Information will be sent to any person requesting notice of the final action.
