PROPOSED ORDER

Dale County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to Phillip Dickerson d/b/a Phillip’s Auto Recycling & Salvaging, Inc., located at 28 Harrell Lane, in Ozark, Dale County, Alabama.
                                                      
The violations consisted of operating without a valid NPDES Permit and failure to submit the required semiannual DMRs.

The Department is proposing a civil penalty in the amount of $5,000.00.  The order, if issued, would require Phillip Dickerson d/b/a Phillip’s Auto Recycling & Salvaging, Inc., to submit a permit application with application fee, comply with all terms, conditions, and limitations of its reissued General NPDES Permit Number ALG180793, to enroll into the Department’s Electronic Discharge Monitoring Report (DMR) Reporting System Program, to prepare an Engineering Report with the corrective actions taken to ensure the implementation and maintenance of Best Management Practices (BMPs), and to pay the civil penalty.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Glenda L. Dean, Chief of Water Division, PO Box 301463, Montgomery, Alabama 36130-1463.  The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed order is available on the ADEM webpage at http://adem.alabama.gov/compInfo/adminOrders.cnt or may be obtained by written request to the above address.  A nominal fee for copying may be charged.

This notice is hereby given this 27th day of June, 2019, by authorization of the Alabama Department of Environmental Management.
