NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

BALDWIN COUNTY

Baldwin County Commission – Magnolia Sanitary Landfill, 312 Courthouse Square Suite 12, Bay Minette, AL 36507, NPDES Permit Number AL0069345, located at 15140 County Road 49, Summerdale, AL 36580, for reissuance with modification of a permit, which authorizes discharges resulting from stormwater runoff that contains landfill wastewater as defined by 40 CFR 445 through DSN001 to an unnamed tributary to Barner Branch, classified as Fish & Wildlife, in the Mobile River Basin; and stormwater runoff associated with industrial activity through DSN002 to an unnamed tributary to Schoolhouse Branch, classified as Fish & Wildlife, in the Mobile River Basin.

COLBERT COUNTY

United Treating and Distribution, LLC, 338 East Washington Avenue, Muscle Shoals, Alabama 35661, NPDES Permit Number AL0076953, located at the same address, for reissuance of a permit which authorizes discharges resulting from stormwater runoff associated with wood preserving operations and wood storage discharging through Outfalls DSN002, DSN003, DSN004, DSN005, DSN006, and DSN007 to an Unnamed Tributary of Dry Creek, classified as Fish and Wildlife, in the Tennessee River Basin.  The Department has determined that the discharge as proposed by the permit applicant is necessary for important economic and social development in the area in which the receiving water is located.

JEFFERSON COUNTY

USB Alabama, LLC - Plant #6, 710 East Bay Street, Suite 112, Charleston, SC 29403, NPDES Permit Number AL0058971, located at 8250 Hopewell Road, SE, Bessemer, AL 35022, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff and treated sanitary wastewater through Outfall DSN001 to an unnamed tributary to Shades Creek which is classified as Fish & Wildlife, in the Cahaba River Basin.

MADISON COUNTY

Giles and Kendall Inc, 3470 Maysville Road, Huntsville, AL 35811, NPDES Permit Number AL0071650, located at same address, for reissuance of a permit, which authorizes discharges resulting from Boiler blowdown, cooling tower blowdown and process waste water from wood processing operations through  DSN001 to Flint River which is classified as Fish and Wildlife , in the Tennessee River Basin, and from Storm water from fuel storage areas and wood processing operations, and vehicle wash water through  DSN002 to Flint River which is classified as Fish and Wildlife , in the Tennessee River Basin.

MOBILE COUNTY

DPC Enterprises, LP, PO Box 24600, Houston, TX 77229, NPDES Permit Number AL0043605, located at 1200 Jarvis Road, Mobile, AL 36614, for reissuance of a permit, which authorizes discharges resulting from treated process wastewater, hydrostatic test waters, and stormwater associated with chemical manufacturing, through DSN001 to an unnamed tributary to Hog Bayou, classified as Fish & Wildlife, in the Mobile River Basin.

Syngenta Crop Protection Inc. (Syngenta), 410 Swing Road, Greensboro, NC 27409, NPDES Permit Number AL0001970, located at 13500 U.S. Highway 43 North, Bucks, AL 36512, for reissuance of a permit, which authorizes discharges resulting from treated groundwater from the groundwater recovery system, through DSN001 to the Mobile River, classified as Fish & Wildlife, in the Mobile River Basin; overflow of the North rainwater retention pond system consisting of storm water runoff, through DSN002 and DSN003 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife, in the Mobile River Basin; overflow of the South rainwater retention pond system consisting of storm water runoff, through DSN004 and DSN005 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife, in the Mobile River Basin; and storm water runoff from rail spur and former rail loading area, through DSN007 to Cold Creek, classified as Fish & Wildlife, in the Mobile River Basin.

Stella-Jones Corporation, 1051 Highway 25 South, Brierfield, AL 35035, NPDES Permit Number AL0054682, located at 1051 Highway 25 South, Brierfield, AL 35035, for Reissuance of a permit, which authorizes discharges resulting from Boiler blowdown, non-contact cooling water, water softener regeneration effluent and cooling tower blowdown, through  DSN002 to Unnamed Tributary to Shoal Creek which is classified as Fish & Wildlife, in the Cahaba River Basin; and Stormwater associated with the lumber and wood products industry including wood treating operations using Copper Naphthenate, creosote and borate preservatives, through  DSN003 and DSN007, to Unnamed Tributary to Shoal Creek which is classified as Fish & Wildlife, in the Cahaba River Basin.

DALLAS COUNTY

Henry Brick Company – Claude Jack Mine, PO Box 850, Selma, Alabama 36702, NPDES Permit Number AL0082457, located on Race Street, Selma, Dallas County, Alabama, for issuance of a permit that limits discharges of treated drainage from a shale and/or common clay mine and associated areas, discharging to an unnamed tributary to Beech Creek, classified as Fish and Wildlife, in the Alabama River Basin.

ETOWAH COUNTY

Vulcan Construction Materials, LLC – Keener Quarry, 1200 Urban Center Drive, Birmingham, Alabama 35242, NPDES Permit Number AL0073032, located at 9091 US Hwy11 North, Atalla, Etowah County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation limestone quarry and associated areas, discharging to Little Wills Creek, classified as Fish and Wildlife, in the Coosa River Basin.

The Water Works and Sewer Board of the City of Eufaula, PO Box 26, Eufaula, AL  36072, NPDES Permit Number AL0061671, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from the Eufaula WWTP, 845 Pump Station Road Eufaula, AL 36027, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Chattahoochee River (Walter F George Lake) and stormwater runoff to Barbour Creek (Walter F George Lake), waterways classified as Swimming, Fish & Wildlife in the Chattahoochee River Basin.

COLBERT COUNTY

City of Tuscumbia Department of Utilities, PO Box 269, Tuscumbia, AL  35674, NPDES Permit Number AL0080829, for type of reissuance of a permit which limits the discharge of pollutants from reverse osmosis from City of Tuscumbia Department of Utilities - WTP, 307 South Indian Street Tuscumbia, AL 35674, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of reverse osmosis Spring Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

ELMORE COUNTY

Kowaliga Retreat Homeowners Association, Inc., 47 Shoreline Drive, Eclectic, AL  36024, NPDES Permit Number AL0053538, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Kowaliga Retreat WWTP, 35 Shoreline Drive Eclectic, AL  36024, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the, which is classified as Kowaliga Creek (Lake Martin), in the Tallapoosa River Basin.

ESCAMBIA COUNTY

City of Brewton, PO Box 368, Brewton, AL  36427, NPDES Permit Number AL0073580, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from North Brewton Lagoon, 407 Fish Pond Road Brewton, AL  36427, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto Murder Creek, which is classified as Fish and Wildlife, in the Perdido-Escambia River Basin.

FAYETTE COUNTY

City of Fayette, 203 Temple Avenue N, Fayette, AL  35555, NPDES Permit Number AL0054640, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Fayette WWTP, County Road 35 South Fayette, AL  35555, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Sipsey River, which is classified as Fish and Wildlife, in the Black Warrior River Basin. The subject permit also regulates the discharge of storm water runoff to UT to Sipsey River, classified as Fish and Wildlife, in the Black Warrior River Basin.

LAMAR COUNTY

Town of Millport, PO Box 365, Millport, AL 35576, NPDES Permit Number AL0049115, for reissuance of a permit which limits the discharge of pollutants from treated industrial and domestic wastewater from Millport Lagoon, Lagoon Road, Millport, AL 35576, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Luxapallila Creek, classified as Fish and Wildlife, in the Tombigbee River Basin.

MACON COUNTY

Macon County Commission, 101 East Northside Street, Tuskegee, AL  36083, NPDES Permit Number AL0047236, for reissuance of a permit which limits the discharge of pollutants from treated domestic from the Mt. Nebo WWTP, Macon County Road 46 Tuskegee, AL  36083, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewaterto the Persimmon Creek, which is classified as Fish and Wildlife (F&W), in the Tallapoosa River Basin.

Town of Notasulga, PO Box 207, Notasulga, AL  36866, NPDES Permit Number AL0070939, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Notasulga WWTF, 790 Gerald Robinson Road Notasulga, AL  36866, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a sprayfield in the Tallapoosa River Basin and stormwater runoff to Gillespie Creek and unnamed tributary to Gillespie Creek in the Tallapoosa River Basin. The facility is located in the drainage basin of Gillespie Creek and unnamed tributary to Gillespie Creek, which is classified as Fish and Wildlife in the Tallapoosa River Basin.

MARENGO COUNTY

The Water Works and Sewer Board of the City of Demopolis, PO Box 350, Demopolis, AL 36732 NPDES Permit Number AL0043168, for reissuance of a permit which limits the discharge of pollutants from treated industrial and domestic wastewater from Demopolis WWTP, 2101 Water Avenue, Demopolis, AL 36732, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Tombigbee River (Coffeeville Lake), classified as Fish and Wildlife, in the Tombigbee River Basin. The subject permit also regulates the discharge of storm water runoff to UT to Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin.

MARSHALL COUNTY

Guntersville Water and Sewer Board, 705 Blount Avenue, Guntersville, AL 35976 NPDES Permit Number AL0020150, for reissuance of a permit which limits the discharge of pollutants from treated industrial and domestic wastewater from Eastlake WWTP, 3100 Lake Guntersville Parkway, Guntersville, AL 35976, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Tennessee River (Guntersville Lake), classified as Public Water Supply/Swimming/Fish and Wildlife, in the Tennessee River Basin. The subject permit also regulates the discharge of storm water runoff to Tennessee River (Guntersville Lake), classified as Public Water Supply/Swimming/Fish and Wildlife, in the Tennessee River Basin.

ST CLAIR COUNTY

City of Margaret, PO Box 207, Margaret, AL  35112, NPDES Permit Number AL0078204, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Margaret WWTP, County Road 6, Margaret, AL  35112, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated to the Middle Black Creek, which is classified as Fish & Wildlife, in the Cahaba River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
