NOTICE OF PROPOSED CONSENT ORDER

Jefferson County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to the City of Vestavia Hills, MS4 NPDES PERMIT ALS000017, in Vestavia Hills, Jefferson County, Alabama.

The violations consisted of: not performing inspections of priority construction sites at a minimum of monthly to verify use and proper maintenance of BMPs; not submitting an accurate 2018-2019 Annual Report; noncompliance with applicable ADEM rules and permit requirements.

The order, if issued, would require the permittee to: meet the requirements of the Permit and SWMPP regarding qualifying construction sites; pay a civil penalty in the amount of $8,000.

Interested persons may submit written comments, including request for a hearing, within 30-days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Jeffery W. Kitchens, Chief of Water Division, PO Box 301463, Montgomery, Alabama 36130-1463.  The comment period shall end at the close of business 30 days from the publication date of this notice.  A copy of the proposed order is available on the ADEM webpage at http://adem.alabama.gov/compInfo/adminOrders.cnt or may be obtained by written request to the above address.  A nominal fee for copying may be charged.

This notice is hereby given this 29th day of July, 2020, by authorization of the Alabama Department of Environmental Management.
