NOTICE OF PROPOSED RENEWAL OF A MUNICIPAL SOLID WASTE LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

CDG Engineers & Associates Inc., on behalf of the City of Montgomery applied to the Alabama Department of Environmental Management (ADEM) for renewal of the Solid Waste Disposal Facility Permit for the North Montgomery Landfill (Permit 51-01). The waste stream for the North Montgomery Landfill would remain non-hazardous solid wastes, non-infectious, putrescible and non-putrescible wastes including but not limited to household garbage, commercial waste, industrial waste, construction and demolition waste, discarded tires, and rubbish as defined by ADEM Rule 335-13-1-.03. Special waste approved by ADEM may also be accepted. The service area for the North Montgomery Landfill would remain the State of Alabama.  The maximum average daily volume of waste disposed at the North Montgomery Landfill would remain 2000 tons per day of municipal solid waste and 400 tons per day of construction/demolition waste. All previous variances have been requested and shall be approved by the department.

The City of Montgomery also submitted a request for a variance from ADEM Rule 335-13-4-.22(1)(b) requiring waste to be confined to as small an area as possible.  The Permittee has been approved to operate two working faces; the first for the placement of MSW waste and the second for the placement of construction and demolition waste. In addition, both working faces must be confined to as small an area as possible. The Permittee also submitted a request to utilize a 50% soil by volume with the remaining volume of the mixture being wood chips as an alternate daily cover.

The landfill is located in the SW¼ of Section 25, S½ of Section 26, NE¼ of Section 35 and the W½ of Section 36, Township 17 North, Range 17 East.  The permitted facility consists of approximately 340.6 acres, with 158.5 acres for municipal solid waste disposal and 110.0 acres for construction and demolition waste disposal.

Copies of the landfill proposed permits are available for public inspection via the ADEM web site at http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above within 35 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
