NOTICE OF A PROPOSED SOLID WASTE PERMIT MODIFICATION UNDER THE ALABAMA SOLID WASTES & RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Blount County

James E. & Barbara L. Adams have submitted to the Alabama Department of Environmental Management (ADEM) an application to modify the permit for the B & B Tire Landfill (Permit No. 05-07).  The B & B Tire Landfill is located in the Southwest ¼ and Northeast ¼ of Section 36, Township 12 South, Range 2 West in Blount County, Alabama.  On February 20, 2020, the Blount County Commission approved the expansion of the B & B Tire Landfill.  The proposed modification expands the facility boundary from 103.88 acres to 116.25 acres and the proposed modification expands the disposal area from 27.52 acres to 35.65 acres.  Also, the proposed modification increases the maximum average daily volume of waste disposed from 100 tons per day to 500 tons per day.

The Permittee requested that all previously approved variances for the B & B Tire Landfill be applied to the expansion area. The previously approved variances allow the Permittee to cover only the top of the waste weekly and the outer slopes monthly and to use 3 to 1 operating slopes. The Permittee has also been granted a variance which does not require an explosive gas monitoring system at the B & B Tire Landfill. All previously approved variances would be granted in the modified permit.

The waste stream for the B & B Tire Landfill would remain tires, tire parts, conveyor belts and rubber parts.  The service area for the B & B Tire Landfill would remain the States of Alabama, Georgia, Mississippi, Tennessee and Kentucky.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above within 35 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
