NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

CALHOUN COUNTY

Alabama Army National Guard - Pelham Range, Gate 3 Road, Alexandria, AL 36250, NPDES Permit Number AL0083941, located at the same address, for initial issuance of a permit, which authorizes discharges resulting from storm water and wash water from equipment maintenance and washing from UTES #1 through DSN001 to Cane Creek, classified as fish and wildlife, in the Coosa River Basin; storm water and wash water from equipment maintenance and washing from UTES #1 through DSN002 to an unnamed tributary Cane Creek, classified as fish and wildlife, in the Coosa River Basin; storm water from the Horizontal Engineering Training Area through DSN003, DSN004, DSN005, and DSN006 to Unnamed Tributary to Cane Creek, classified as Fish and Wildlife, in the Coosa River Basin; storm water from Rock Crusher Training Area through DSN007, DSN008, DSN009, and DSN010 to Unnamed Tributary to Cane Creek, classified as Fish and Wildlife, in the Coosa River Basin.

Alabama Power Company - Miller Steam Plant, PO Box 2641, Department 12N-0830, Birmingham, Alabama 35291-0830, NPDES Permit Number AL0027146, located at 4250 Porter Road, Quinton, AL 35130, for reissuance of a permit, which authorizes discharges resulting from discharges of treated plant wastewaters and the ash pond dewatering treatment system including ash pond dewatering and decanting wastewaters, cooling tower blowdown, sanitary wastewaters, pretreated chemical metal cleaning wastes, low volume wastewaters, coal pile runoff, FGD wastewaters, CCB leachate, miscellaneous cooling waters, fire protection system waters, and stormwater runoff associated with electric power generation discharging through Outfall DSN005 to the Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin; discharges from the Southwest Retention Pond including stormwater runoff associated with electric power generation, car wash waters, fire protection system waters and wastewaters resulting from cooling tower basin maintenance activities discharging through Outfall DSN008 to Village Creek, classified as Swimming, Fish and Wildlife, in the Black Warrior River Basin; discharges from the Southeast Retention Pond including stormwater runoff associated with electric power generation, fire protection system waters, and wastewaters resulting from cooling tower basin maintenance activities discharging through Outfall DSN009 to Village Creek, classified as Swimming, Fish and Wildlife, in the Black Warrior River Basin; discharges from the Northwest Retention Pond including stormwater runoff associated with electric power generation, stormwater runoff from the gypsum dry storage transfer area, condensate tank overflow, and fire protection system waters discharging through Outfall DSN010 to the Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin; discharges from the Northeast Retention Pond including stormwater runoff associated with electric power generation and fire protection system waters discharging through Outfall DSN011 to the Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin; discharges from the construction landfill including stormwater runoff associated with electric power generation and fire protection system waters discharging through Outfall DSN012 to the Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin; discharges from the North Stormwater Retention Pond including stormwater runoff from the closed ash pond footprint and fire protection system waters discharging through Outfall DSN013 to the Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin; discharges from the South Stormwater Retention Pond including stormwater runoff from the closed ash pond footprint and fire protection system waters discharging through Outfall DSN014 to the Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin.  At this time, the Department has determined that the cooling water intake structure represents the interim best technology available (40 CFR 125.98(b)(6)) to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C. section 1326).

MOBILE COUNTY

Global Oil Environmental Services, LLC - GOES - Theodore Facility, 7455 Rangeline Road, Theodore, AL 36582, NPDES Permit Number AL0080551, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff from a non-hazardous oilfield waste treatment facility through DSN001 and DSN002 to Theodore Industrial Canal, classified as Fish & Wildlife, in the Mobile River Basin.

Nouryon Chemicals LLC, 13440 Highway 43 North, Axis, AL 36505, NPDES Permit Number AL0001961, located at the same address, for reissuance of a permit, which authorizes discharges resulting from treated wastewater from the manufacture of organic and inorganic chemicals, sanitary and utility wastewaters, Halby site groundwater recovery system, RCRA groundwater recovery wells, process area stormwater runoff and treated groundwater through DSN001 to the Mobile River, classified as Fish & Wildlife and stormwater runoff from the north facility and Crystex plant sites through outfall DSN002 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife and stormwater runoff from sulfur chlorides area, former chlorine plant area, former brine mud surge tank and brine mud pond areas through outfalls DSN003 – DSN007 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife and stormwater runoff from sandblasting and sand storage areas, acid plant, administrative building, plant rail spur and entrance road areas through outfalls DSN008 – DSN011 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife.  All outfalls are located in the Mobile River Basin.  

MONTGOMERY COUNTY

Kukdong USA, Inc. – Hope Hull AL USA Facility, 7765 Bill Joseph Parkway, Montgomery, AL 36105, NPDES Permit Number AL0082864, located at same address, for reissuance of a permit, which authorizes discharges resulting from storm water runoff from bulk chemical storage operations, through DSN001 to an unnamed tributary to Pintlala Creek, classified as Fish & Wildlife, in the Alabama River Basin; and storm water runoff from the loading dock and southern paved areas, through DSN002 to an unnamed tributary to Pintlala Creek, classified as Fish & Wildlife, in the Alabama River Basin.

TALLADEGA COUNTY

Georgia-Pacific Wood Products LLC – Talladega Lumber, 400 Ironaton Cutoff Road, Talladega, AL 35160, NPDES Permit Number AL0083704, located at same address, for modification of a permit, which authorizes discharges resulting from storm water associated with lumber and wood products manufacturing and petroleum storage and handling, vehicle and equipment wash water, and condensate, through DSN003 to an unnamed tributary to Kelly Creek, classified as Fish & Wildlife, in the Coosa River Basin; and storm water associated with lumber and wood products manufacturing, through DSN009 to an unnamed tributary to Kelly Creek, classified as Fish & Wildlife, in the Coosa River Basin.

MACON COUNTY

Wiregrass Construction Company – Hickory Bend Mine, 1342 Carmichael Way, Montgomery, Alabama 36117, NPDES Permit Number AL0077631, located at 2291 Tysonville Loop, Shorter, Macon County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation construction sand and gravel mine and associated areas, discharging to Tallapoosa River, classified as Public Water Supply and Fish and Wildlife, Cubahatchee Creek, classified as Swimming and Other Whole Body Water-Contact Sports and Fish and Wildlife, and to an unnamed tributary to Tallapoosa River, unnamed tributaries to Cubahatchee Creek, unnamed tributaries to Line Creek, and Line Creek, classified as Fish and Wildlife, in the Tallapoosa River Basin.

 

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
