PROPOSED CONSENT ORDER
Tuscaloosa County
Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§ 22-22A-1 to 22-22A-17, as amended; the Alabama Scrap Tire Environmental Quality Act, Ala. Code §§ 22-40A-1 to 22-40A-24, as amended; and the ADEM Administrative Code of Regulations, the Alabama Department of Environmental Management is proposing to issue a Consent Order to David Moore dba The Fast Tire Company, LLC, a Scrap Tire Facility located at 3506 Greensboro Avenue, Tuscaloosa, Tuscaloosa County, Alabama.
The violations listed in the Order consist of tires exposed longer than 30 days, no vector control plan, exceedance of storage limit, failure to submit quarterly reports, failure to maintain operating record, and failure to maintain copies of manifests in the operating record.
The Department is proposing a civil penalty in the amount of $7,000.00. The Order, if issued, would require the owner to comply with all applicable provisions of ADEM Admin. Code div. 335-4 including removal of all scrap tires in excess of the accumulation limit of 1,500, develop/implement a vector control plan, develop/implement a plan to submit timely quarterly reports, develop and maintain an operating record as required, etc.

The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
