PROPOSED ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to enter into an Order of Consent with Warrior Met Coal Mining, LLC, which operates a mining facility known as Mine No. 4. The entrance to the mine is located at 14730 Lock 17 Road, Brookwood, Tuscaloosa County, Alabama.   

The Order addresses AWPCA and NPDES permit violations for discharge of pollutants from a point source not identified in NPDES Permit No. AL0026590; failure to conduct operations in such a manner as to not place in a stream or cause to be placed in a stream material associated with mining operations; and failure to properly implement and maintain its Spill Prevention, Control, and Countermeasures (SPCC) Plan.

The Department is proposing a civil penalty in the amount of $27,750. The Order, if executed, would require Warrior Met Coal Mining, LLC to pay the proposed civil penalty; to continue to submit reports associated with its progress towards achieving compliance with an existing Remediation Plan; and to submit certification by a Professional Engineer licensed to practice in Alabama indicating compliance with all requirements of the Order.

Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to the Alabama Department of Environmental Management, attention Jeffery W. Kitchens, Chief of the Water Division, P.O. Box 30l463, Montgomery, Alabama 36l30-l463. The comment period shall end at the close of business 30 days from the publication date of this notice.
