NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

ESCAMBIA COUNTY

Georgia-Pacific Brewton, LLC, Post Office Box 709, Brewton, AL 36427, NPDES Permit Number AL0002682, located at 32224 Highway 31 South, Brewton, AL 36426 for reissuance of a permit which limits the existing discharges resulting from process wastewaters, ash pond and lime settling pond overflow, and stormwater runoff from the mill site, wood yard, and landfill areas, landfill leachate, and sanitary wastewater, discharging through DSN001, combined effluent from oxidation pond effluent (North and South channels) and Central Junction discharging through DSN002, and stormwater runoff from industrial activity, blowdown from the mill water treatment plant, and runoff from the wood yard discharging through DSN03A, to the Conecuh River, classified as Fish and Wildlife; stormwater runoff associated with the landfill and additional industrial activity discharging through DSN006 to DSN009, stormwater runoff associated with minimal industrial activity discharging through DSN011 and DSN012, and stormwater runoff associated with industrial activity discharging through DSN013 and DSN014 to an unnamed tributary to the Conecuh River, classified as Fish and Wildlife; stormwater runoff associated with minimal industrial activity discharging through DSN010, stormwater runoff associated with paved employee parking areas discharging through DSN015 and DSN016, and stormwater runoff associated with industrial activity discharging through DSN017 to DSN022 to Franklin Mill Creek, classified as Fish and Wildlife, all located within the Perdido-Escambia River Basin.

In accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and the federal regulations (40 CFR Part 125), if applicable, the cooling water intake structure used by the Permittee has been evaluated using available information.  At this time, the Department has determined that the cooling water intake structure used by the Permittee represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326).

MOBILE COUNTY

Ineos Phenol, a Division of INEOS Americas, LLC, NPDES Permit Number AL0072401, located at 7770 Rangeline Road, Theodore, AL 36582 for reissuance of a permit which limits existing discharges resulting from fire system test water, nitrogen and air systems condensate water, and storm water runoff from non-process associated with organic chemical manufacturing discharging through DSN001 into the Middle Fork of Deer River, classified as Fish and Wildlife, in the Mobile River Basin; discharges resulting from uncontaminated storm water from the dock secondary containment area discharging through DSN002 into the Middle Fork of Deer River, classified as Fish and Wildlife, in the Mobile River Basin.

DE KALB COUNTY

Kennedy Brothers Construction, LLC – John Poe Mine, 17160 Lock 17 Road, Brookwood, Alabama 35444, NPDES Permit Number AL0082252, located at 756 County Road 676, Fort Payne, DeKalb County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation coal mining operation and associated areas, discharging to Town Creek, unnamed tributaries to Town Creek, Biddle Spring Branch, and unnamed tributaries to Biddle Spring Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

HENRY COUNTY

Imerys Refractory Minerals USA, Inc. - JL Corbitt Pit 1, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit Number AL0082163, located on County Road 207, Abbeville, Henry County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine, and associated areas, discharging to unnamed tributary to Piney Woods Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

MARSHALL COUNTY

Stephen Yant – Tucker’s Pit, 1054 McCorkle Mountain Road, Scottsboro, Alabama 35769, NPDES Permit Number AL0082937, located at 30413 US Highway 431 South, Grant, Marshall County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation dirt and/or chert mine and associated areas, discharging to Little Paint Rock Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

RANDOLPH COUNTY

Wadley Crushed Stone Company, LLC – Wadley Quarry, Post Office Box 129, Wadley, Alabama 36276, NPDES Permit Number AL0079456, located at 874 County Road 838, Wadley, Randolph County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation granite mine and associated areas, discharging to Groundwater, Tallapoosa River, and unnamed to Tallapoosa River, classified as Fish and Wildlife, in the Tallapoosa River Basin.

WALKER COUNTY

McWane, Inc. – Dilworth Washer, 1201 Vanderbilt Road, Birmingham, Alabama 35234, NPDES Permit Number AL0067113, located at 4377 Hull Road, Empire, Walker County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry and wet coal preparation plant and associated areas, discharging to the Mulberry Fork of the Black Warrior River, classified as Public Water Supply and Fish and Wildlife, in the Black Warrior River Basin.

Birmingham Coal & Coke Co., Inc. – Old Union Mine No. 2, 912 Edenton Street, Birmingham, Alabama 35242, NPDES Permit Number AL0080098, located on Winston County Road 70, Nauvoo, Winston County, Alabama 35578, for issuance of a permit that limits discharges resulting from treated drainage from a wet preparation coal mining operation and associated areas, discharging to Blackwater Creek, Unnamed Tributaries to Blackwater Creek, Browns Creek, Unnamed Tributary to Browns Creek, Indian Creek, Unnamed Tributary to Indian Creek, Long Branch, Splunge Creek, and Unnamed Tributaries to Splunge Creek, all classified as Fish & Wildlife, in the Black Warrior River Basin.

Calhoun County Board of Education, Post Office Box 2084, Anniston, AL 36202, NPDES Permit Number AL0055727, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ohatchee School WWTP, 100 Cherokee Trail, Ohatchee, AL 36271 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Ohatchee Creek, classified as Swimming/Fish & Wildlife, in the Coosa River Basin.

CRENSHAW COUNTY

The Town of Brantley, Post Office Box 44, Brantley, AL 36009, NPDES Permit Number AL0022641, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Brantley Lagoon, Glenwood Road, Brantley, AL 36009, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Conecuh River, classified as Fish & Wildlife, in the Escambia River Basin.

MADISON COUNTY

Madison County Board of Education, Post Office Box 226 , Huntsville, AL 35804, NPDES Permit Number AL0048810, for revocation and reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Central School WWTP, 990 Ryland Pike, Huntsville, AL 35811, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Flint River, classified as Fish & Wildlife, in the Tennessee River Basin.

Town of Owens Cross Roads, 9032 Highway 431 S, Owens Cross Roads, AL 35763, NPDES Permit Number AL0053228, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Owens Cross Roads WWTP, 231 Snead Avenue, Owens Cross Roads, AL 35763, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Flint River, classified as Fish & Wildlife, in the Tennessee River Basin.

ST CLAIR COUNTY

St. Clair Health and Rehab, Inc., 7300 US Highway 78, Pell City, AL 35128, NPDES Permit Number AL0057096, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from St. Clair Health and Rehab, Inc., 7300 US Highway 78, Pell City, AL 35128 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Cane Creek, classified as Fish & Wildlife, in the Coosa River Basin.

TALLAPOOSA COUNTY

City of Alexander City, Post Office Box 552, Alexander City, AL 35011, NPDES Permit Number AL0067695, for reissuance of a permit which limits the discharge pf pollutants from filter backwash from Charles C. Adams III Water Treatment Plant, 291 Adams Circle, Alexander City, AL 35010, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of filter backwash to the Tallapoosa River (Lake Martin), a waterway classified as Public Water Supply, Swimming, and Fish & Wildlife, in the Tallapoosa River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
