NOTICE OF A PROPOSED SOLID WASTE PERMIT MODIFICATION UNDER THE ALABAMA SOLID WASTES & RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Marshall County

The City of Guntersville submitted to the Alabama Department of Environmental Management (ADEM) an application to modify the construction and demolition landfill permit for the Guntersville Landfill (Permit No. 48-11)

The Guntersville Landfill is described as being located in the Southeast ¼ of the Northeast ¼ of Sections 31, Township 8 South, Range 3 East in Marshall County, Alabama.  The permit modification increases the permitted facility area from 20.24 acres to 41.08 acres and increases the permitted disposal area from 7.96 acres to 13.63 acres.  As part of the application, the City of Guntersville requested a variance from ADEM Rule 335-13-4-.20(2)(c)2. requiring that the maximum final grade of the final cover system shall not exceed 25 percent (4 to 1).  The final cover system shall not exceed a final grade of 3 to 1.  All other permit conditions will remain unchanged.

The waste stream for the Guntersville Landfill would remain nonputrescible and nonhazardous construction and demolition waste and rubbish as defined by ADEM Rule 335-13-1-.03.  Also, the facility may continue to accept tires for disposal.  The service area for the Guntersville Landfill would remain the City of Guntersville, Alabama.  The maximum average daily volume of waste disposed at the Guntersville Landfill would remain 200 cubic yards per day.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above within 35 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes & Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
