Littrell Brothers Lumber Company, PO Box 40, Vinemont, AL 35179, NPDES Permit Number AL0066460, located at 20345 Hwy 31 N, Vinemont, AL 35179, for reissuance of a permit, which authorizes discharges resulting from Stormwater associated with lumber and wood products industry including wood treating operations through DSN001, to U.T. to East Fork of Flint Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

ETOWAH COUNTY

Koch Foods of Gadsden, LLC, 501 Paden Road, Gadsden, AL 35903, NPDES Permit Number AL0002119, located at the same address, for modification of a permit, which authorizes discharges resulting from stormwater runoff associated with industrial activity from poultry processing facility through DSN005 to Coosa River (Neely Henry Lake), classified as Fish and Wildlife, in the Coosa River Basin.  The Department has determined that the discharge as proposed by the permit applicant is necessary for important economic and social development in the area in which the receiving water is located.

MARSHALL COUNTY

Price Rubber Corp – Top Flight Mixing Plant, PO Box 89, Guntersville, AL 35976, NPDES Permit Number AL0000523, located at 3805 Morrow Street, Guntersville, AL 35976, for reissuance of a permit, which authorizes discharges resulting from Discharge of contact and non-contact cooling water from rubber manufacturing operations through DSN001 to Polecat Branch, classified as Public Water Supply, Swimming, and fish and wildlife in the Tennessee River Basin.  The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the source of the water is private groundwater wells.

MOBILE COUNTY

*Evonik Corporation, PO Box 868, Theodore, AL 36590, NPDES Permit Number AL0023272, located at 4201 Degussa Road, Theodore, AL 36582, for reissuance of a permit, which authorizes discharges resulting from treated process wastewaters from the manufacture of inorganic and organic chemicals, boiler blowdown, non-contact cooling water, cooling tower blowdown, contaminated stormwater and treated groundwater through DSN001 to Theodore Industrial Barge Canal (Middle Fork Deer River), classified as Fish & Wildlife, stormwater runoff from North site non-process areas through DSN002 to an unnamed tributary to Middle Fork Deer River, classified as Fish & Wildlife, stormwater runoff from East site non-process areas and stormwater from non-process areas associated with the BASF and BCS facilities and hydrostatic test water from the BCS site through DSN003 to an unnamed tributary to Middle Fork Deer River, classified as Fish & Wildlife and South site stormwater runoff from non-process areas through DSN005 to an unnamed tributary to Middle Fork Deer River, classified as Fish & Wildlife.  All discharges are located in the Mobile River Basin.  The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the entity providing water is a public water system.

SSAB Alabama, Inc., 12400 US Highway 43 North, Axis, AL 36505, NPDES Permit Number AL0072109, located at 12400 US Highway 43 North, Axis, AL 36505, for reissuance of a permit, which authorizes discharges resulting from, contact cooling water, non-contact cooling water, rolling mill non-contact cooling water system blowdown and storm water runoff associated with the manufacture of steel through DSN001 to the Mobile River, classified as Fish & Wildlife and groundwater from well commissioning and storm water runoff from scrap yard, slag storage and process areas, the scrap bucket loading area and railroad marshalling yard through DSN002 to Carter Branch, classified as Fish & Wildlife, and groundwater from well commissioning and storm water runoff from the bulk of steel manufacturing operations and the outside storage yards for steel plate, slab and coils through DSN003 to Carter Branch, classified as Fish & Wildlife and groundwater from well commissioning and storm water runoff from melt shop operations and alloy storage areas through DSN004 to Carter Branch, classified as Fish & Wildlife.  All discharges are located in the Mobile River Basin.  The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the source of the water is private groundwater wells.

*U. S. Amines (Bucks) LLC, 14086 US Highway 43 North, Axis, AL 36505, NPDES Permit Number AL0003085, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater from non-process areas, the former SBS plant and petroleum storage containment areas and well water associated with fire protection through DSN001 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife, and process wastewater from organic chemical manufacturing, boiler blowdown, RO unit reject water, stormwater from former sodium hydrosulfite and SBS plants, lab wastewater and non-contact cooling water through DSN002 to the Mobile River, classified as Fish & Wildlife, and stormwater from contractor staging area and warehouse through DSN003 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife and stormwater from former SO2 plant and maintenance shop through DSN004 to an unnamed tributary to Cold Creek, classified a Fish & Wildlife and stormwater from former SO2 plant, Amines and wastewater treatment plant through DSN006 to Cold Creek, classified as Fish & Wildlife and stormwater from wastewater treatment area through DSN007 to Cold Creek, classified as Fish & Wildlife and stormwater from Amines tank farm through DSN008 to Cold Creek, classified as Fish & Wildlife and stormwater from Amines tank farm, contractor’s yard and former Hydrosulfite plant through DSN009 to Cold Creek, classified as Fish & Wildlife.  All receiving streams are located in the Mobile River Basin.  The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the source of the water is private groundwater wells.

MORGAN COUNTY

Terral RiverService LLC, 4402 East Main Street, Blytheville Arkansas 72315, NPDES Permit Number AL0084131, located on a barge on the south bank of the Tennessee River at approximately river mile 297.3, Independence Avenue, Decatur, Alabama, 35601, for initial issuance of a permit which authorizes discharges associated with barge washing operations discharging through Outfall DSN001 into the Tennessee River, classified as Swimming, Fish & Wildlife, in the Tennessee River Basin.  ADEM Administrative Rule 335-6-10-.12 requires applicants to new or expanded discharges to Tier II waters demonstrate that the proposed discharge is necessary for important economic or social development in the area in which the waters are located.  The application submitted by the facility is not for a discharge to a Tier II water body; therefore, anti-degradation requirements do not apply.

TUSCALOOSA COUNTY

Trace Energy, Inc. - Barge Loading Facility, PO Box 661135, Birmingham, AL 35266, NPDES Permit Number AL0043524, located at 3074 Jack Warner Parkway, Tuscaloosa, AL 35401, for TERMINATION of a permit, which authorizes discharges resulting from stormwater from coke storage and loading operations, discharging through outfall DSN001 to the Black Warrior River, classified as Fish & Wildlife, in the Black Warrior River Basin.

*The facilities above with an asterisk (“*”) are considered a “Major” source as determined by EPA’s NPDES Non-Municipal Permit Rating System.

TUSCALOOSA COUNTY

MRC-FG, LLC - Mine No 7 Prep Plant, 5002 Monument Avenue, Richmond, Virginia 23230, NPDES Permit Number AL0084140, located at 18069 Hannah Creek Road, Brookwood, Tuscaloosa County, Alabama, for issuance of a permit that limits discharges of treated drainage from a coal wet preparation plant and associated areas, discharging to unnamed tributaries to Davis Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

ELMORE COUNTY

The Central Elmore Water and Sewer Authority, 65 Lake Point Road, Eclectic, AL 36024, NPDES Permit Number AL0071315, for reissuance of a permit which limits the discharge of pollutants from filter backwash from the Central Elmore Water and Sewer Authority Filter Plant, 65 Lake Point Road, Eclectic, AL 36024, for the purpose of meeting federal and state water quality regulatory standards. Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
