NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

MADISON COUNTY

National Copper LLC, 3333 Stanwood Blvd, Huntsville, AL 35811, NPDES Permit Number AL0029483, located at the same address, for modification of a permit, which authorizes discharges resulting from storm water runoff associated with copper tubing re-draw mill operations through DSN001 to an unnamed tributary to Chase Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin; discharges resulting from non-contact cooling water from a remediated ground source discharging from DSN002 to an unnamed tributary to Chase Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

MOBILE COUNTY

Millard Maritime LLC, 7730 Deer River Rd, Theodore, AL 36582, NPDES Permit Number AL0081752, located at the same address, for reissuance of a permit, which authorizes discharges resulting from fire protection test water and stormwater runoff from the unloading, storage and loading of industrial salts, bulk fertilizers, and Calcium Carbonate and stormwater associated with above ground diesel storage tank, through DSN002 to Middle Fork Deer River (Theodore Barge Canal), classified as Fish & Wildlife, in the Mobile River Basin.

Petroleum Fuel & Terminal Co., 200 Viaduct Road, Chickasaw, AL, 36611, NPDES Permit Number AL0043320, located at 1257 Cochrane Causeway, Mobile, AL 36610, for reissuance of a permit, which authorizes discharges resulting from storm water runoff from petroleum storage and handling areas, treated tank bottoms and/or water draws, hydrostatic test water, and boiler blowdown, through DSN001 to the Mobile River, classified as Limited Warmwater Fishery, in the Mobile River Basin.

RUSSELL COUNTY

WestRock Company-WestRock Coated Board LLC, PO Box 940, Phenix City, AL 36868, NPDES Permit Number AL0000817, located at Highway 165 South, Cottonton, AL 36851, for reissuance of a permit, which authorizes discharges resulting from process wastewater from the manufacture of coated natural (unbleached) kraft paperboard, ash pond decant, sanitary wastewater, landfill leachate, and intermittent discharges from DSN002, through DSN001 to the Chattahoochee River, classified as Fish & Wildlife, in the Chattahoochee River Basin; non-contact cooling water, stormwater associated with industrial activity, parking lots recycle area, wood ash storage area, and sawmill area, and water from car wash area, through DSN002 to the Chattahoochee River, classified as Fish & Wildlife, in the Chattahoochee River Basin; stormwater runoff associated with pulp and paper manufacturing, through DSN004 to Mill Creek, classified as Fish & Wildlife, in the Chattahoochee River Basin; stormwater runoff associated with pulp and paper manufacturing, through DSN005, DSN008, DSN009, DSN012, DSN014, and DSN020 to the Chattahoochee River, classified as Fish & Wildlife, in the Chatthoochee River Basin; stormwater runoff associated with pulp and paper manufacturing, through DSN016 to an unnamed tributary to Rock Creek, classified as Fish & Wildlife, in the Chattahoochee River Basin; stormwater runoff associated with pulp and paper manufacturing and DSN019A, through DSN019 to Mill Creek, classified as Fish & Wildlife, in the Chattahoochee River Basin. At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

DE KALB COUNTY

Carbon Oak, Inc. – Thunder Oaks Mine, PO Box 306, Guntersville, Alabama 35976, NPDES Permit Number AL0081817, located at 1101 County Road 683, Sylvania, DeKalb County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation coal mining operation associated areas, discharging to Wolf Branch, Bengis Creek, and unnamed tributaries to Bengis Creek, all classified as Fish and Wildlife, in the Tennessee River Basin.

JEFFERSON COUNTY

Whitaker Contracting Corp. – Flat Top Processing Plant, PO Box 306, Guntersville, Alabama 35976, NPDES Permit Number AL0083330, located at 4625 Flat Top Road, Adamsville, Jefferson County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation sandstone processing plant and associated areas, discharging to Coal Creek, unnamed tributaries to Coal Creek, and Wolf Branch, all classified as Fish and Wildlife, in the Black Warrior River Basin.

WALKER COUNTY

Prospect Mining & Development Co., Inc. – Carbon Hill Mine, 2002 2nd Avenue, Jasper, Alabama 35501, NPDES Permit Number AL0079553, located at County Road 63, Carbon Hill, Walker County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation coal mining operation and associated areas, discharging to an unnamed tributary to Cranford Creek and Cranford Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

DALE/HOUSTON COUNTY

City of Dothan, 126 North Saint Andrews Street, Suite 201, Dothan, AL  36303, NPDES Permit Number AL0047465, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Dothan Little Choctawhatchee WWTP, 412 Clearwater Drive, Dothan, AL  36303, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Little Choctawhatchee River, which is classified as Fish and Wildlife, and stormwater runoff to an unnamed tributary to the Little Choctawhatchee River Basin, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

HOUSTON COUNTY

City of Dothan, 126 North Saint Andrews Street, Suite 201, Dothan, AL  36303, NPDES Permit Number AL0072737, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Dothan New Cypress Creek WWTP, 2431 Helms Road, Dothan, AL  36301, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Limestone Creek, which is classified as Fish and Wildlife, in the Chipola River Basin.

LAWRENCE COUNTY

City of Moulton, 720 Seminary Street, Moulton, AL 35650, NPDES Permit Number AL0020672, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Moulton WWTP, 120 Beacon Street Moulton, AL 35650, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Crow Branch, which is classified as Agricultural and Industrial Water Supply, in the Tennessee River Basin.

PERRY COUNTY

City of Marion, 123 E. Jefferson Street, Marion, AL  36756, NPDES Permit Number AL0023809, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Marion WWTP, Moore Street Extension, Marion, AL  36756, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Rice Creek, which is classified as Fish and Wildlife, in the Cahaba River Basin.

SUMTER COUNTY

City of Livingston, Post Office Drawer W, Livingston, AL  35470, NPDES Permit Number AL0023256, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Livingston Lagoon, Adjacent to 405 Arrington Street Livingston, AL  35470, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Sucarnoochee River, which is classified as Fish and Wildlife (F&W) in the Tombigbee River Basin.

TUSCALOOSA COUNTY

Kendall South LLC, c/o Newport Pacific Capital Company, 17300 Red Hill Ave, STE 280, Irvine, CA  92614, NPDES Permit Number AL0072427, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Stonegate Community WWTP, 15100 Stonegate Drive Coaling, AL 35453, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a sprayfield in the Black Warrior River Basin. The facility is located in the drainage basin of the Black Warrior River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
