PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to the Guin Water and Sewer Board (PWSID AL0000924), which operates a public water system under Public Water Supply Permit 2016-675, located at 6788 US Highway 43 in Guin, Marion County, Alabama.

The violations consisted of assigning non-certified individuals to operate a Grade IV surface water treatment plant and failure to notify the Department in writing of personnel changes affecting its certification compliance within 30 days.

The Department is proposing a civil penalty in the amount of $150,000.00.  The Guin Water and Sewer Board shall immediately ensure a Grade IV certified water operator is in responsible charge at all times the plant is operating and shall submit to the Department a list of all Grade IV operators assigned to work at the treatment plant or provide a contract if a contractor is utilized.

The comment period shall end at the close of business 30 days from the publication date of this notice.
