NOTICE OF PROPOSED REMEDIATION PLAN UNDER THE ALABAMA HAZARDOUS WASTES MANAGEMENT AND MINIMIZATION ACT (AHWMMA) CLEANUP AGREEMENT AND REQUEST FOR COMMENTS

SABIC Innovative Plastics US LLC of Burkville, Alabama entered into Cleanup Agreement ALD 981 026 677 with ADEM on March 5, 2012, for its facility located at 1 Plastics Drive, Burkville, Alabama.  The Remedial Plan is being implemented to address the PCE spill site at the Chlorine Enclosure Building and the Caustic Spill site.

SABIC operates a polycarbonate resin manufacturing plant on approximately 6,300 acres of land.  The production area is approximately 300 acres located centrally within the property.  A spill of tetrachloroethylene (PCE) occurred on July 5, 2011 and was excavated to remove PCE in soil; however, confirmation samples collected along the bottom portion of the excavation indicated PCE concentrations above the ADEM preliminary screening value (PSV). Based on this finding, SABIC voluntarily agreed to undertake certain environmental investigations and remediation measures in accordance with appropriate regulatory procedures.

A release of liquid thirty two percent sodium hydroxide (caustic) was reported on February 19, 2019, (Tank V1635A) and April 23, 2019, (Tank V1635B). These two tanks are situated within the same containment structure. A solid waste management unit (SMWU) report was submitted to ADEM on May 20, 2019. This study identified that elevated pH in soil and groundwater was present after the conclusion of a cleanup excavation. The elevated pH is expected to be controlled and treated with the existing interim remedial measures (IRM) system. The reason for this modification is to incorporate the Caustic Spill Site SWMU and the previously planned expansion of the IRM system to provide additional control and treatment of groundwater south of the site.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above within 45 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed Remedial Plan.

A written request for a public hearing may also be filed within that 45-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the AHWMMA, the Federal Resource, Conservation and Recovery Act (RCRA) and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
