NOTICE OF REQUEST FOR A REVIEW OF A COASTAL CONSISTENCY VARIANCE FOR AN ACTIVITY REQUIRING A
FEDERAL LICENSE OR PERMIT

In accordance with ADEM Administrative Code r. 335-8-1-.14, the Alabama Department of Environmental Management (ADEM) hereby gives notice that Robert Zarr Jr. has applied to ADEM for a variance pursuant to ADEM Admin. Code r. 335-8-1-.13.

Robert Zarr Jr. requests a variance from ADEM Admin. Code r. 335-8-2-. and seeks authorization to develop a coastal parcel for residential and recreational purposes on parcel 05-55-03-07-0-000-078 in Daphne, Baldwin County, Alabama. The project entails filling approximately 0.21 acres (9,336 square feet) of coastal wetlands with 346 cubic yards of commercially obtained fill material for constructing a single-family residence. To counteract erosion and stabilize the property's shoreline, the project will place 79 cubic yards riprap along 124 linear feet of the Fish River bank, impacting an additional 0.055 acres (2,395.8 square feet) of state waterbottoms. Furthermore, the development includes constructing a 5-foot-wide by 60-foot-long (300 square feet) access pier, leading to a 30-foot by 30-foot (900 square feet) boat shelter with a deck and a single boat slip, facilitating direct access to Fish River. The proposal is being reviewed by the U.S. Army Corps of Engineers under SAM-2023-00405-STB. Mitigation for wetlands impacts would be through the purchase of mitigation credits from an approved mitigation bank.

Any person wishing to make comments or provide additional information relative to the proposed activity’s consistency with the ACAMP must submit such comments or information by letter or by email to ADEM at the address below within fifteen (15) calendar days following the publication date of this notice. Only those comments which address issues within the Department’s scope of authority can be considered. All correspondence regarding this proposal must reference application number ACAMP-2023-232-VAR.

Copies of all information submitted are available for public inspection at the ADEM office located at the above address Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. Arrangements for review and copying should be made in advance. After consideration of all written comments and consideration of the requirements of the Alabama Coastal Area Management Act and ADEM Coastal Program rules, the Department will make a final determination. The Department’s determination, associated documents and all comments received during the public comment period will be available for inspection at the ADEM office located at the above address during normal working hours and on the Department’s eFile system. Notice of the final decision will be sent to any person who requests such notice in writing during this comment period.
