PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to GRI-APS, the owner/operator of an ethylene oxide sterilization facility in Columbia, Houston County, Alabama.

The violation consisted of beginning construction of the facility without an air permit at a greenfield site.

The Department is proposing a civil penalty in the amount of $50,000. The Order, if issued, would require GRI-APS to operate in compliance with ADEM Admin. Code 335-3 and all conditions and requirements of Air Permit 607-0046-X001.
