NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

AUTAUGA COUNTY

International Paper-Prattville Mill, 100 Jensen Road, Prattville, Alabama 36067, NPDES Permit Number AL0003115, located at the same address, for reissuance of a permit, which limits existing discharges resulting from process wastewaters, landfill leachate, wet decking process water, and storm water runoff from the construction and production area, landfill, wood yard, and the clay borrow pit through DSN001 and noncontact turbine condenser cooling water through DSN002 discharging into the Alabama River, classified as Fish and Wildlife, and non-contact fire pump pressure relief water, mill supply pump seal water, fire suppression system water, and storm water runoff from the bark pile, oversized wood, skeet shooting range, and process water treatment areas through DSN003 discharging into Autauga Creek, classified as Fish and Wildlife, located in the Alabama River Basin.

In accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and the federal regulations (40 CFR Part 125), if applicable, the cooling water intake structure used by the Permittee has been evaluated using available information.  At this time, the Department has determined that the cooling water intake structure used by the Permittee represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326).

MARENGO COUNTY

WestRock Mill Company, LLC – Demopolis, 28270 U.S. Highway 80 West, Demopolis, Alabama 36732, NPDES Permit Number AL0002828, located at the same address, for reissuance of a permit, which limits existing discharges resulting from process wastewater associated with pulp and paper manufacturing, sanitary wastewater, and stormwater runoff through DSN001, landfill leachate, ash pond overflow, boiler blowdown, demineralizer wastewater, stormwater runoff, process wastewater from the chip mill, including wet-deck log storage wastewater through DSN005, stormwater runoff from the borrow pit area through DSN006, stormwater runoff from the bark pile and surrounding areas through DSN009 and DSN010 discharging into the Tombigbee River, classified as Fish and Wildlife, and stormwater runoff from log truck entrance roads through DSN007 and DSN008 discharging into an unnamed tributary to the Tombigbee River, classified as Fish and Wildlife, located in the Tombigbee River Basin.

MOBILE COUNTY

Williams Mobile Bay Producer Services, LLC., NPDES Permit Number AL0072575, located at 6000 Rock Road, Alabama Port, Alabama 36523 for termination of a permit which limits existing discharges resulting from settling basin discharge consisting of storm water runoff associated with natural gas processing and helicopter pad wash water discharging through DSN001 into Jonas Bayou, classified as Fish and Wildlife, in the Escatawpa River Basin and discharges resulting from settling basin discharge consisting of reverse osmosis backwash, hydrostatic test water, turbine wash water, evaporative coolers water and storm water associated with natural gas processing discharging through DSN004 into Jonas Bayou, classified as Fish and Wildlife, in the Escatawpa River Basin.

MORGAN COUNTY

Falkville Wood Treating Inc, NPDES Permit Number AL0077275, located at 4384 Highway 31 Southwest, Falkville, Alabama 35622, for reissuance of existing discharges resulting from stormwater runoff associated with milling and creosote wood preserving operations discharging through Outfalls DSN001, DSN002, and DSN003 to an Unnamed Tributary of Painter Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

Polyplex USA LLC, NPDES Permit Number AL0082210, located at 3001 Mallard Fox Drive North West, Decatur, Alabama 35601, for issuance of a permit modification to include the discharge of fire pump gland water and fire water discharging through Outfall DSN001 into an Unnamed Tributary of the Tennessee River, classified as Fish & Wildlife in the Tennessee River Basin.

SHELBY COUNTY

Plantation Pipeline Company – Helena Tank Farm, 900 Shelby County Road 52 East, Helena, Alabama 35080, NPDES Permit Number AL0061603, located the same address, for reissuance of a permit, which limits existing discharges resulting from treated groundwater from petroleum remediation through DSN001 discharging into Buck Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

TUSCALOOSA COUNTY

Merichem Company, 2701 Warrior Road, Tuscaloosa, Alabama 35404, NPDES Permit Number AL0025330, located at the same address, for reissuance of a permit which limits the existing discharges resulting from Non-chlorinated, non-contact cooling water, and non-process related storm water runoff discharging through DSN001; Stormwater from non-process areas on east side of plant discharging through DSN002; Storm water from secondary containment areas and non-process areas associated with the manufacture of Naphthenic acid and other chemical products discharging through DSN003; Storm water from non-process areas associated with the manufacture of catalysts discharging through DSN006 and DSN007; and Stormwater from diked tank storage area associated with manufacture of catalysts discharging through DSN008. Each outfall discharges to Black Warrior River, classified as Fish and Wildlife, in the Black Warrior River Basin.

BLOUNT COUNTY

Tremendous Stone, LLC – Rocky Mountain Quarry, Post Office Box 1786, Oneonta, Alabama 35121, NPDES Permit Number AL0083950, located at 76 Rocky Mountain Road, Oneonta, Blount County, Alabama, for initial issuance of a permit that limits discharges from dry preparation sandstone mine and associated area, discharging to an unnamed tributary to Calvert Prong, classified as Fish and Wildlife, in the Black Warrior River Basin.

BALDWIN COUNTY

Triangle – Stonebridge 2014, LLC, 29891 Woodrow Lane, Ste. 300, Spanish Fort, Alabama 36527, NPDES Permit Number AL0078794, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Golden Triangle WWTP, Three Mile Creek Road, Loxley, Alabama 36551 for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Fish River, classified as Swimming and Fish and Wildlife, in the Mobile River Basin and stormwater runoff to an Unnamed Tributary to Fish River, classified as Fish and Wildlife, in the Mobile River Basin.

CULLMAN COUNTY

Hanceville Water Works and Sewer Board, 203 Main Street NW, Hanceville, Alabama 35077, NPDES Permit Number AL0057029, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Hanceville WWTP, 380 Brighter Street SE, Hanceville, Alabama 35077 for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Mud Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

DALLAS COUNTY

The Dallas County Water and Sewer Authority, Post Office Box 1413, Selma, Alabama 36702, NPDES Permit Number AL0043176, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from the Dallas County Wastewater Treatment Plant, Craig Airport Authority Building 278, Selma, Alabama 36701, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Sixmile Creek, classified as Fish and Wildlife, in the Alabama River Basin and stormwater runoff to Sixmile Creek, classified as Fish and Wildlife, in the Alabama River Basin.

LAUDERDALE COUNTY

El Reposo Nursing Facility, 260 Milners Chapel Road, Florence, Alabama 35634 NPDES Permit Number AL0056715, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from El Reposo Nursing Facility Lagoon, County Road 8 and County Road 344, Florence, Alabama 35634, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Cowpen Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

MOBILE COUNTY

Water Works and Sewer Board of the City of Prichard, Post Office Box 10455, Prichard, Alabama 36610, NPDES Permit Number AL0055204, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and storm water runoff from Stanley Brooks WWTP, located at the end of Aldock Road, Prichard, Alabama 36610 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Chickasaw Creek classified as Fish & Wildlife, in the Mobile River Basin and storm water runoff to Eightmile Creek, classified as Fish & Wildlife, in the Mobile River Basin.

SHELBY COUNTY

The Alabama Department of Conservation and Natural Resources, 200 Terrace Drive, Pelham, Alabama 35124, NPDES Permit Number AL0050831, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Oak Mountain State Park, 200 Terrace Drive, Pelham, Alabama 35124, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to an unnamed tributary to Dry Brook, classified as Fish and Wildlife, in the Cahaba River Basin.

ST CLAIR COUNTY

Health Care, Inc., Post Office Box 130, Ashville, Alabama 35953, NPDES Permit Number AL0057975, reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Health Care Inc., 38286 Highway 231, North, Ashville, Alabama 35953, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Muckleroy Creek, classified as Fish & Wildlife, in the Coosa River Basin.

Pinedale water, Sewer and Fire Protection Authority, 58 Shore Drive, Ashville, Alabama 35953, NPDES Permit Number AL0074616, for revocation and reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Pinedale WWTP, 5111 Shore Drive, Ashville, Alabama 35953, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Big Canoe Creek, classified as Fish & Wildlife, in the Coosa River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
