NOTICE OF APPLICATION FOR AIR PERMIT AND
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT

AND REQUEST FOR COMMENTS

TUSCALOOSA AND BIBB COUNTIES

Davis Materials, Inc., PO Box 1099, Tuscaloosa, AL 35403, has applied for air and water permits for a proposed limestone quarry, known as Vance Pit, to be located less than one mile from the intersection of US Highway 11 and Story Road, Vance, Alabama 35490.

Davis Materials, Inc. has applied for issuance of a National Pollutant Discharge Elimination System (NPDES) Permit, NPDES Permit Number AL0083917M/a>, for proposed discharges of treated drainage from a wet and dry preparation limestone quarry and associated areas to Banks Creek, classified as Fish and Wildlife in the Black Warrior River Basin.  The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Rules including the Department’s Anti-degradation Rules.

Davis Materials, Inc. has also applied for an Air Permit, Facility No. 413-0120, which would authorize the construction and operation of a limestone crushing, screening, and conveying operation.  Emissions of particulate matter would be minimized by the use of wet suppression. The Department has determined that the equipment/operations proposed by the company should be able to meet State and federal air pollution control requirements.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.
In order to affect final decisions, comments must offer technically substantial information that is applicable to the applications or proposed permits.  All comments must address the conditions of the proposed permits; the Department’s adherence to the applicable environmental laws, rules, and regulations in development of the draft permits; or issues that have an impact on the applicant’s ability to meet applicable environmental laws, rules, and regulations to affect the final permit decision. 
A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of relevant public interest in the permit applications or draft permits.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Air Pollution Control Act, the federal Clean Air Act, the Alabama Pollution Control Act, the federal Clean Water Act, and all other applicable regulations, the Department will make a final determination.  The Department will develop a response to comments which will be posted to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and respective final permit determinations, you may search by the permit or facility number listed in this notice.
