PROPOSED ADMINISTRATIVE ORDER

Perry County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Donald W. Miller and Ronald W. Miller dba Don & Ron Enterprises, Inc. for failure to close an unauthorized dump located at Uniontown, Perry County, Alabama.

The violations consisted of Don & Ron Enterprises, Inc. creating and not properly closing an unauthorized dump and scrap tire site. 

The Department is proposing a civil penalty in the amount of $41,250.  The Order, if issued, would require Don & Ron Enterprises, Inc. to cease and desist the operation of the unauthorized dump and scrap tire site, and to submit an abatement plan to the Department.  This plan would require the removal and proper disposal of all regulated wastes and tires, and a schedule for abatement completion.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:

This notice is hereby given this 3rd day of April, 2019, by authorization of the Alabama Department of Environmental Management.
