Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Evonik Corporation, the owner/operator of a chemical manufacturing production facility currently operating in Theodore, Mobile County, Alabama.

The violations consisted of the failure to monitor differential pressure for Baghouses 402 and 407 for 41 days.

The Department is proposing a civil penalty in the amount of $28,500. The Order, if issued, would require Evonik Corporation to pay the Alabama Department of Environmental Management within 45 days of the effective date of the Consent Order. Evonik must also operate in compliance with ADEM Admin Code 335-3.
